Ce faisant, il permet au futur acqu\u00e9reur de r\u00e9server le bien immobilier qu&#8217;il convoite en s&#8217;assurant que le promoteur ne le c\u00e8de \u00e0 personne d&#8217;autre.<\/p>\n<h1><span id=\"Modalites_de_calcul_et_versement_du_depot_de_garantie\">Modalit\u00e9s de calcul et versement du d\u00e9p\u00f4t de garantie<\/span><\/h1>\n<p>La\u00a0somme du d\u00e9p\u00f4t est un pourcentage du prix de vente pr\u00e9visionnel. Elle d\u00e9pend \u00e9galement du d\u00e9lai entre la <a href=\"https:\/\/www.getunlatch.com\/fr\/blog\/immobilier\/vefa-contrat-de-reservation\/\">signature du contrat de r\u00e9servation<\/a> et celle du contrat de vente.<\/p>\n<h2><span id=\"Le_vendeur_peut-il_exiger_un_depot_de_garantie\">Le vendeur peut-il exiger un d\u00e9p\u00f4t de garantie ?<\/span><\/h2>\n<p>Oui, mais il doit respecter un encadrement l\u00e9gal.<\/p>\n<p>Le montant du d\u00e9p\u00f4t de garantie est plafonn\u00e9, sous peine de sanctions p\u00e9nales pour le vendeur qui exigerait un montant sup\u00e9rieur.<\/p>\n<p>Ainsi le d\u00e9p\u00f4t de garantie vers\u00e9 par l\u2019acheteur s&#8217;\u00e9tablit en fonction du prix pr\u00e9visionnel et des d\u00e9lais de livraison du bien immobilier concern\u00e9 :<\/p>\n<ul>\n<li>5% maximum du prix pr\u00e9visionnel de vente si la signature du contrat d\u00e9finitif de vente est pr\u00e9vue dans l&#8217;ann\u00e9e de signature du contrat de r\u00e9servation donc est inf\u00e9rieur ou \u00e9gal \u00e0 1 an,<\/li>\n<li>2% maximum du prix pr\u00e9visionnel de vente si la signature de l&#8217;acte de vente doit intervenir entre 1 et 2 ans apr\u00e8s celle du contrat de r\u00e9servation.<\/li>\n<li>Pas de d\u00e9p\u00f4t de garantie si le d\u00e9lai est sup\u00e9rieur \u00e0 2 ans.<\/li>\n<\/ul>\n<p>En revanche, l\u2019acheteur peut tout \u00e0 fait n\u00e9gocier cette somme \u00e0 la baisse.<\/p>\n<h2><span id=\"Le_vendeur_peut-il_exiger_que_les_fonds_lui_soient_remis_directement\">Le vendeur peut-il exiger que les fonds lui soient remis directement ?<\/span><\/h2>\n<p>Non, le <a href=\"https:\/\/www.getunlatch.com\/fr\/\">promoteur immobilier<\/a> n&#8217;est pas autoris\u00e9 \u00e0 formuler une telle demande. Le d\u00e9p\u00f4t est donc vers\u00e9 sur un compte bloqu\u00e9 au nom du r\u00e9servataire, chez une banque ou un notaire.
