De par sa nature, il emporte des cons\u00e9quences importantes sur le contrat car il est partie int\u00e9grante de la vente.<br \/>\nAinsi, il fait office de garantie pour l&#8217;acqu\u00e9reur, qui peut se reposer sur la description du plan de masse pour \u00e9valuer la conformit\u00e9 du bien livrer et faire valoir ses droits.<\/p>\n<h1><span id=\"Que_faire_en_cas_de_non-respect_du_plan_de_masse\">Que faire en cas de non-respect du plan de masse ?<\/span><\/h1>\n<p>La livraison d&#8217;un bien non conforme \u00e0 la disposition du plan de masse est une modification unilat\u00e9rale du contrat par le promoteur. Ce dernier peut donc voir sa responsabilit\u00e9 engag\u00e9e pour violation de son obligation de d\u00e9livrance conforme.<\/p>\n<p>En effet, puisque le plan de masse a \u00e9t\u00e9 d\u00e9pos\u00e9 chez le notaire en annexe \u00e0 l&#8217;acte de vente,\u00a0son contenu\u00a0entre dans le champ contractuel (<a href=\"https:\/\/www.legifrance.gouv.fr\/affichJuriJudi.do?idTexte=JURITEXT000007032858\">Cass. 3e civ., 26 mai 1994 : Bull. civ. 1994, III, n\u00b0 110, p. 70<\/a>).<\/p>\n<p>Or <a href=\"https:\/\/www.legalife.fr\/guides-juridiques\/vos-droits-acheteur-immobilier\/#Definition_de_l8217obligation_de_delivrance\">l\u2019obligation de d\u00e9livrer <\/a>une chose conforme oblige le vendeur \u00e0 livrer un bien r\u00e9pondant aux caract\u00e9ristiques pr\u00e9vues entre les deux parties. C&#8217;est pour cette raison qu&#8217;il est n\u00e9cessaire que ces pr\u00e9cisions apparaissent dans le contrat. Elles permettent une comparaison objective entre la chose livr\u00e9e et celle souhait\u00e9e.
