href=\"https:\/\/www.courdecassation.fr\/publications_26\/arrets_publies_2986\/troisieme_chambre_civile_3171\/2017_7950\/mai_8092\/550_18_36837.html\">arr\u00eat rendu le 18 mai 2017<\/a>, la garantie de conformit\u00e9 des prestations et des niveaux de performance attendus d\u2019un bien achet\u00e9 en VEFA s\u2019appr\u00e9cie par rapport aux seules mentions de la notice descriptive.<\/p>\n<h2><span id=\"Valeur_contractuelle_de_la_notice_descriptive\">Valeur contractuelle de la notice descriptive<\/span><\/h2>\n<p>En effet, les documents publicitaires pr\u00e9sent\u00e9s par le promoteur n\u2019ont aucune valeur juridique. Tant qu&#8217;ils ne rel\u00e8vent pas de publicit\u00e9 mensong\u00e8re, ils n\u2019engagent pas le vendeur.<\/p>\n<p>Ainsi, la notice descriptive est l&#8217;unique document portant une valeur contractuelle \u00e0 cet \u00e9gard. Elle pr\u00e9domine donc toute autre informations dispens\u00e9es par le vendeur au cours du processus d&#8217;achat.<\/p>\n<p>La r\u00e9daction de la notice descriptive est donc une \u00e9tape clef de l&#8217;achat en VEFA. De ce fait,\u00a0la\u00a0notice lie le vendeur par une obligation contractuelle particuli\u00e8rement pr\u00e9cise au b\u00e9n\u00e9fice de l&#8217;acheteur.<\/p>\n<h2><span id=\"Quand_redige-t-on_la_notice\">Quand r\u00e9dige-t-on la notice ?<\/span><\/h2>\n<ul>\n<li>Lors de la r\u00e9servation du logement, un premier document, d\u00e9crivant les ouvrages et les prestations, doit \u00eatre joint au contrat pr\u00e9liminaire<\/li>\n<li>Lors de l&#8217;acte de vente authentique chez le notaire, une notice descriptive doit \u00eatre annex\u00e9e \u00e0 cet acte.
