Il est tout \u00e0 fait possible d&#8217;exercer toute activit\u00e9 parmi celles cit\u00e9es en pr\u00e9cisant uniquement &#8220;tous commerces&#8221; sur le contrat de bail.<\/p>\n<p>Le <a href=\"https:\/\/www.legalife.fr\/guides-juridiques\/le-bail-professionnel\/\">bail<strong> professionnel<\/strong> <\/a>est un contrat de location qui s&#8217;adresse essentiellement aux <strong>professions lib\u00e9rales.\u00a0<\/strong>Ainsi les personnes concern\u00e9es par ce type bail ont n\u00e9cessairement une profession dont les revenus sont impos\u00e9s en tant que b\u00e9n\u00e9fices non commerciaux (BNC) c&#8217;est-\u00e0-dire : les architectes, les avocats, les chirurgiens-dentistes, les experts-comptable, les infirmiers lib\u00e9raux, les masseurs-kin\u00e9sith\u00e9rapeutes, les m\u00e9decins, les sages-femmes, les v\u00e9t\u00e9rinaires notamment.<\/p>\n<h2><span id=\"Forme_du_contrat_de_bail\">Forme du contrat de bail<\/span><\/h2>\n<p>Le bail<strong> commercial<\/strong> ne n\u00e9cessite pas d&#8217;\u00eatre un contrat \u00e9crit mais cela est cependant fortement conseill\u00e9 pour des raisons de s\u00e9curit\u00e9 juridique.<\/p>\n<p>Le bail <strong>professionnel<\/strong>, lui, doit obligatoirement \u00eatre r\u00e9dig\u00e9. Cela peut \u00eatre par un notaire ou par elles-m\u00eames. Dans ce dernier cas, il est possible de faire contresigner le contrat par un avocat.<\/p>\n<h2><span id=\"Duree_du_bail\">Dur\u00e9e du bail<\/span><\/h2>\n<p>Le bail<strong> commercial<\/strong> est un bail qui dure au minimum 9 ann\u00e9es \u00e0 moins que ce soit une location saisonni\u00e8re ou un bail d\u00e9rogatoire. Il faut que la dur\u00e9e exacte soit pr\u00e9cis\u00e9e, ce ne peut \u00eatre une dur\u00e9e ind\u00e9termin\u00e9e. Quoi qu&#8217;il en soit il est possible pour <a href=\"https:\/\/www.legalife.fr\/modele\/conge-du-bail-commercial-par-le-locataire\/\">le locataire de donner cong\u00e9 au bout de 3 ans<\/a>.<\/p>\n<p>Le bail <strong>professionnel<\/strong>, quant \u00e0 lui, doit au moins durer 6 ans.<\/p>\n<h2><span id=\"Loyer\">Loyer<\/span><\/h2>\n<p>Pour le bail<strong> commercial<\/strong>, le loyer n&#8217;est pas r\u00e9glement\u00e9 et il peut \u00eatre fix\u00e9 librement entre le bailleur et le locataire.<\/p>\n<p>Pour le bail <strong>professionnel<\/strong>, il en est de m\u00eame. Il est n\u00e9cessaire cependant que le montant du loyer ainsi que ses modalit\u00e9s de paiement soient pr\u00e9cis\u00e9s dans le contrat de bail.<\/p>\n<h2><span id=\"Fin_du_bail\">Fin du bail<\/span><\/h2>\n<p>Pour un bail<strong> commercial<\/strong>, si aucune d\u00e9marche n&#8217;est faite, il est prolong\u00e9 automatiquement (et non pas renouvel\u00e9) de mani\u00e8re tacite. Cela signifie qu&#8217;il poursuit ses effets mais le locataire n&#8217;est plus titulaire du droit au bail. Si le locataire souhaite y mettre fin, il peut le faire par acte d&#8217;huissier ou lettre recommand\u00e9e avec avis de r\u00e9ception si jamais il s&#8217;agit d&#8217;un d\u00e9part \u00e0 la retraite ou si l&#8217;on arrive \u00e0 expiration d&#8217;une p\u00e9riode 3 ans. S&#8217;agissant du bailleur, il peut uniquement donner cong\u00e9 par acte d&#8217;huissier \u00e0 son preneur. Dans tous les cas, le cong\u00e9 doit \u00eatre notifi\u00e9 \u00e0 l&#8217;autre partie avec un pr\u00e9avis de 6 mois avant le terme initial du bail. Si le locataire souhaite mettre fin au contrat de bail, il le peut \u00e0 tout moment en le notifiant \u00e0 son bailleur par acte d&#8217;huissier ou lettre recommand\u00e9e avec avis de r\u00e9ception 6 mois avant de partir. Quant au bailleur, il ne peut terminer le contrat qu&#8217;au moment de son expiration.<\/p>\n<h2><span id=\"Renouvellement\">Renouvellement<\/span><\/h2>\n<p>Pour le\u00a0bail<strong> commercial<\/strong>, lorsque le contrat arrive \u00e0 terme, le propri\u00e9taire du fonds de commerce b\u00e9n\u00e9ficie du droit \u00e0 renouvellement.\u00a0Ainsi s&#8217;il veut renouveler son bail, le\u00a0preneur doit le demander par acte d&#8217;huissier ou lettre recommand\u00e9e avec avis de r\u00e9ception, dans les 6 mois qui pr\u00e9c\u00e8dent l&#8217;expiration du bail. Le bailleur a alors 3 mois pour accepter le renouvellement ou le refuser. Si jamais il ne r\u00e9pond, cela est consid\u00e9r\u00e9 comme une acceptation.<\/p>\n<p>Pour le bail\u00a0<strong>professionnel<\/strong>, il n&#8217;y a pas de droit au renouvellement.
