Lors de la rupture conventionnelle du contrat de travail, certains salari\u00e9s (les salari\u00e9s prot\u00e9g\u00e9s) b\u00e9n\u00e9ficient d\u2019une protection sp\u00e9ciale au titre des articles L. 2411-1 et L2411-2 du Code du travail. Le formulaire CERFA \u00e0 utiliser est le <a title=\"CERFA 14599*01\" href=\"https:\/\/www.formulaires.modernisation.gouv.fr\/gf\/cerfa_14599.do\">CERFA 14599*01.<\/a><\/p>\n<h2 style=\"text-align: justify;\">Les salari\u00e9s prot\u00e9g\u00e9s<\/h2>\n<p style=\"text-align: justify;\">Si le salari\u00e9 concern\u00e9 par la rupture conventionnelle fait partie la liste ci-dessous, la proc\u00e9dure est diff\u00e9rente de celle de droit commun :<\/p>\n<ul>\n<li>d\u00e9l\u00e9gu\u00e9 syndical<\/li>\n<li>d\u00e9l\u00e9gu\u00e9 du personnel<\/li>\n<li>membre \u00e9lu du comit\u00e9 d\u2019entreprise<\/li>\n<li>repr\u00e9sentant syndical au comit\u00e9 d\u2019entreprise<\/li>\n<li>membre du groupe sp\u00e9cial de n\u00e9gociation et membre du comit\u00e9 d\u2019entreprise europ\u00e9en<\/li>\n<li>membre du groupe sp\u00e9cial et repr\u00e9sentant au comit\u00e9 de la soci\u00e9t\u00e9 coop\u00e9rative europ\u00e9enne<\/li>\n<li>membre du groupe sp\u00e9cial de n\u00e9gociation et repr\u00e9sentant au comit\u00e9 de la soci\u00e9t\u00e9 coop\u00e9rative europ\u00e9enne<\/li>\n<li>membre du groupe sp\u00e9cial de n\u00e9gociation et repr\u00e9sentant au comit\u00e9 de la soci\u00e9t\u00e9 issues de la fusion transfrontali\u00e8re<\/li>\n<li>repr\u00e9sentant du personnel au comit\u00e9 d\u2019hygi\u00e8ne, de s\u00e9curit\u00e9 et des conditions de travail<\/li>\n<li>repr\u00e9sentant du personnel d\u2019une entreprise ext\u00e9rieure, d\u00e9sign\u00e9 au comit\u00e9 d\u2019hygi\u00e8ne, de s\u00e9curit\u00e9 et des conditions de travail d\u2019un \u00e9tablissement comprenant au moins une installation class\u00e9e<\/li>\n<li>membre d\u2019une commission paritaire d\u2019hygi\u00e8ne, de s\u00e9curit\u00e9 et des conditions de travail en agriculture pr\u00e9vue \u00e0 l\u2019article L.717-7 du code rural et de la p\u00eache maritime<\/li>\n<li>salari\u00e9 mandat\u00e9 dans les entreprises d\u00e9pourvues de d\u00e9l\u00e9gu\u00e9 syndical<\/li>\n<li>repr\u00e9sentant des salari\u00e9s au sens de l\u2019article L. 662-4 du code de commerce<\/li>\n<li>repr\u00e9sentant des salari\u00e9s au conseil d\u2019administration ou de surveillance des entreprises du secteur public, des soci\u00e9t\u00e9s anonymes et des soci\u00e9t\u00e9s en commandite par actions<\/li>\n<li>membre du conseil ou administrateur d\u2019une caisse de s\u00e9curit\u00e9 sociale<\/li>\n<li>membre du conseil d\u2019administration d\u2019une mutuelle, union ou f\u00e9d\u00e9ration<\/li>\n<li>repr\u00e9sentant des salari\u00e9s dans une chambre d\u2019agriculture<\/li>\n<li>conseiller du salari\u00e9 inscrit sur une liste dress\u00e9e par l\u2019autorit\u00e9 administrative et charg\u00e9 d\u2019assister les salari\u00e9s convoqu\u00e9s par leur employeur en vue d\u2019un licenciement<\/li>\n<li>Conseiller prud\u2019homme<\/li>\n<\/ul>\n<h2 style=\"text-align: justify;\">Protection particuli\u00e8re<\/h2>\n<p>Au lieu de proc\u00e9der par l\u2019homologation de l\u2019autorit\u00e9 administrative, la convention de rupture conventionnelle doit faire l\u2019objet d\u2019une autorisation de la part de l\u2019inspecteur du travail. La rupture du contrat de travail ne peut alors intervenir qu\u2019\u00e0 partir du lendemain de l\u2019autorisation.<\/p>\n<p>Les m\u00e9decins du travail b\u00e9n\u00e9ficient \u00e9galement d\u2019un r\u00e9gime d\u00e9rogatoire en la mati\u00e8re, puisque la rupture conventionnelle est soumise \u00e0 l\u2019autorisation de l\u2019inspecteur du travail apr\u00e8s l\u2019avis du m\u00e9decin inspecteur de travail.<\/p>\n<p>La rupture conventionnelle est inapplicable dans les cas o\u00f9 le contrat de travail r\u00e9sulterait des accords collectifs de gestion pr\u00e9visionnelle des emplois et des comp\u00e9tences.
