Cette recherche s\u2019effectue dans le logement et dans un rayon de 10 m\u00e8tres autour. Ce document vise \u00e0 informer le candidat acqu\u00e9reur sur le bien qu&#8217;il projette d&#8217;acheter.<br \/>\nLe contenu de cette expertise parasitaire doit mentionner le bien concern\u00e9, les parties visit\u00e9es ainsi que les \u00e9l\u00e9ments infest\u00e9s par la pr\u00e9sence de termites.<\/p>\n<p>Le diagnostic doit \u00eatre r\u00e9alis\u00e9 par un professionnel certifi\u00e9 par un <a href=\"http:\/\/diagnostiqueurs.application.developpement-durable.gouv.fr\/index.action\" target=\"_blank\" rel=\"noopener noreferrer\">organisme accr\u00e9dit\u00e9 par le Comit\u00e9 fran\u00e7ais d&#8217;accr\u00e9ditation (Cofrac)<\/a>. A l\u2019aide d\u2019un poin\u00e7on, le diagnostiqueur effectue de petits sondages sur l\u2019ensemble du bien immobilier : pi\u00e8ces principales, grenier, charpente accessible, sous-sol, d\u00e9pendances et jardin.<\/p>\n<h2><span id=\"Quels_sont_les_immeublesconcernes_par_l8217etat_relatif_a_la_presence_de_termites\">Quels sont les immeubles\u00a0concern\u00e9s par l&#8217;\u00e9tat relatif \u00e0 la pr\u00e9sence de termites ?<\/span><\/h2>\n<p>Le diagnostic termites concerne tous les immeubles b\u00e2tis (maisons, appartement, local d\u2019activit\u00e9) situ\u00e9s dans des zones dites \u00ab contamin\u00e9es \u00bb. Ces zones, class\u00e9es \u00e0 risques, sont d\u00e9clar\u00e9es par un arr\u00eat\u00e9 pr\u00e9fectoral comme \u00e9tant infest\u00e9e par les termites. En copropri\u00e9t\u00e9, l\u2019\u00e9tat relatif \u00e0 la pr\u00e9sence de termites ne concerne que les parties privatives du lot. Ce diagnostique obligatoire s\u2019applique \u00e9galement aux terrains non b\u00e2tis ainsi qu\u2019aux immeubles \u00e0 destination commerciale.<\/p>\n<p>Votre commune est t-elle\u00a0concern\u00e9e par l\u2019obligation de diagnostic termites ? Consultez le site de l\u2019<a href=\"http:\/\/termite.com.fr\/\" target=\"_blank\" rel=\"noopener noreferrer\">observatoire national des termites de la FCBA<\/a>.<\/p>\n<h2><span id=\"Quelle_est_l8217obligation_dinformation_mise_a_la_charge_du_vendeur_de_l8217immeuble\">Quelle est l&#8217;obligation d\u2019information mise \u00e0 la charge du vendeur de l&#8217;immeuble ?<\/span><\/h2>\n<p>En cas de vente de tout ou partie d\u2019un immeuble b\u00e2ti situ\u00e9 dans les zones class\u00e9s \u00ab contamin\u00e9es \u00bb, le propri\u00e9taire-vendeur doit fournir un diagnostic termites. Le contenu de l\u2019\u00e9tat relatif \u00e0 la pr\u00e9sence de termites doit obligatoirement \u00eatre annex\u00e9 \u00e0 la promesse ou au contrat de vente. Dans le cas contraire, le vendeur ne pourra s&#8217;exon\u00e9rer de la garantie des vices cach\u00e9s. Il faut par cons\u00e9quent \u00eatre vigilant. Il doit avoir \u00e9t\u00e9 effectu\u00e9 au maximum six mois avant la signature du <a href=\"https:\/\/www.legalife.fr\/modele\/compromis-de-vente\/\">compromis de vente<\/a> ou, \u00e0 d\u00e9faut, de l\u2019<a href=\"https:\/\/www.legalife.fr\/guides-juridiques\/signer-acte-de-vente-immobiliere-notaire\/\">acte authentique de vente<\/a>.<\/p>\n<h2><span id=\"Quelle_est_la_consequence_d8217un_etat_relatif_a_la_presence_de_termites_positif\">Quelle est la cons\u00e9quence d&#8217;un \u00e9tat relatif \u00e0 la pr\u00e9sence de termites positif\u00a0?<\/span><\/h2>\n<p>Si le diagnostic conclut \u00e0 l\u2019infestation de termites, le propri\u00e9taire est tenu d\u2019en informer la mairie de sa commune dans le mois suivant cette d\u00e9couverte. Le propri\u00e9taire doit alors prendre les mesures n\u00e9cessaires. Il doit proc\u00e9der \u00e0 la d\u00e9sinsectisation du b\u00e2timent dont l\u2019\u00e9tat de d\u00e9gradation pr\u00e9sente un danger pour ses occupants. A d\u00e9faut de telles mesures, la municipalit\u00e9 peut les lui ordonner dans les d\u00e9lais qu\u2019elle impose. S&#8217;ils ne sont pas respect\u00e9s, la mairie peut engager les travaux \u00e0 la place et aux frais du propri\u00e9taire.<\/p>\n<h2><span id=\"Quelle_est_la_responsabilite_du_vendeur_a_defaut_de_production_d8217unetat_relatif_a_la_presence_de_termites\">Quelle est la responsabilit\u00e9 du vendeur \u00e0 d\u00e9faut de production d&#8217;un\u00a0\u00e9tat relatif \u00e0 la pr\u00e9sence de termites ?<\/span><\/h2>\n<p>Si le propri\u00e9taire n\u2019annexe pas de diagnostic termites, ce dernier ne pourra \u00eatre exon\u00e9r\u00e9 de la garantie des vices cach\u00e9s.
