Il dresse, le cas \u00e9ch\u00e9ant, un relev\u00e9 des facteurs de d\u00e9gradations du b\u00e2ti. Est annex\u00e9e \u00e0 ce constat une notice d&#8217;information. Le CREP doit \u00eatre r\u00e9alis\u00e9 par un professionnel disposant d\u2019une certification d\u00e9livr\u00e9e par un organisme accr\u00e9dit\u00e9 par la COFRAC.<\/p>\n<h2><span id=\"Quels_sont_les_batiments_concernes_par_l8217obligation_d8217etablir_un_constat_de_risque_d8217exposition_au_plomb\">Quels sont les b\u00e2timents concern\u00e9s par l&#8217;obligation d&#8217;\u00e9tablir un constat de risque d&#8217;exposition au plomb ?<\/span><\/h2>\n<p>L&#8217;<a href=\"https:\/\/www.legifrance.gouv.fr\/affichCodeArticle.do?cidTexte=LEGITEXT000006072665&amp;idArticle=LEGIARTI000006686769&amp;dateTexte=&amp;categorieLien=cid\" target=\"_blank\" rel=\"noopener noreferrer\">article L 1334-7 du Code de la sant\u00e9 publique<\/a> pr\u00e9voit qu\u2019un CREP doit \u00eatre \u00e9tabli pour tous les b\u00e2timents \u00e0 usage d\u2019habitation, construits avant le 1er janvier 1949. Cela concerne tant les maisons individuelles que les immeubles collectifs.<\/p>\n<p>Le CREP porte exclusivement sur<strong> les parties privatives du logement<\/strong>, y compris les rev\u00eatements ext\u00e9rieurs (les volets par exemple). Les canalisations en plomb ne sont pas concern\u00e9es par le champ d\u2019application du CREP.<\/p>\n<p>Pour les locaux soumis au statut de la copropri\u00e9t\u00e9, le CREP ne porte que sur les seules parties privatives de l\u2019immeuble. Concernant les parties communes, la copropri\u00e9t\u00e9 est tenue de r\u00e9aliser les travaux.<\/p>\n<p>Les travaux comprennent, d&#8217;une part, les travaux\u00a0visant les sources de plomb elles-m\u00eames et, d&#8217;autre part, ceux visant \u00e0 assurer la p\u00e9rennit\u00e9 de la protection. Ceux-ci doivent \u00eatre r\u00e9alis\u00e9s avant la mise en location du logement.<\/p>\n<p>Si le diagnostic fait appara\u00eetre la pr\u00e9sence de facteurs de d\u00e9gradation du b\u00e2ti, il est imm\u00e9diatement transmis au pr\u00e9fet. Il est int\u00e9gr\u00e9 dans le Dossier de diagnostic technique (DDT) annex\u00e9 \u00e0 tout nouveau contrat de bail. A ce moment l\u00e0, le CREP doit avoir \u00e9t\u00e9 \u00e9tabli <strong>au moins six ans avant la signature du bail.\u00a0<\/strong>Toutefois, si le constat \u00e9tablit l&#8217;absence de rev\u00eatements contenant du plomb ou la pr\u00e9sence de plomb \u00e0 des concentrations inf\u00e9rieures aux seuils l\u00e9gaux, il n&#8217;y a pas lieu de faire \u00e9tablir un nouveau constat \u00e0 chaque contrat de location.
