Face \u00e0 ces enjeux de sant\u00e9 publique, des obligations ont \u00e9t\u00e9 mise \u00e0 la charge des propri\u00e9taire en mati\u00e8re de rep\u00e9rage de l\u2019amiante.<\/p>\n<p>Dans l\u2019hypoth\u00e8se d\u2019une vente, le vendeur a l\u2019obligation de fournir l\u2019\u00e9tat complet du diagnostique d\u2019amiante annex\u00e9 \u00e0 l\u2019acte de vente. En cas de pr\u00e9sence d\u00e9tect\u00e9e, un diagnostic de l\u2019\u00e9tat de conservation de l\u2019amiante dans les mat\u00e9riaux et produits rep\u00e9r\u00e9s doit \u00eatre dress\u00e9. Doivent \u00e9galement \u00eatre mises en oeuvre\u00a0les mesures n\u00e9cessaires pour contr\u00f4ler et r\u00e9duire l\u2019exposition \u00e0 l\u2019amiante.<\/p>\n<p>A ce jour, tous les logements concern\u00e9s devraient en principe avoir \u00e9t\u00e9 diagnostiqu\u00e9s.<\/p>\n<h2><span id=\"Les_obligations_d8217information_a_la_charge_du_bailleur\">Les obligations d&#8217;information \u00e0 la charge du bailleur<\/span><\/h2>\n<h3><span id=\"Lobligation_dannexer_letat_damiante_en_copie_du_contrat_de_bail_d8217habitation\">L\u2019obligation d\u2019annexer l\u2019\u00e9tat d\u2019amiante en copie du contrat de bail d&#8217;habitation<\/span><\/h3>\n<p>Depuis le 1er avril 2013, le propri\u00e9taire bailleur est tenu de mettre \u00e0 la disposition du locataire le diagnostic amiante.<\/p>\n<p>D\u00e9sormais,<strong> le contrat de location reprend cette obligation.<\/strong><\/p>\n<p>En effet, la<a href=\"https:\/\/www.legifrance.gouv.fr\/affichTexte.do?cidTexte=JORFTEXT000028772256&amp;categorieLien=id\" target=\"_blank\" rel=\"noopener noreferrer\"> loi ALUR du 24 mars 2014 <\/a>exige qu&#8217;une copie de l&#8217;\u00e9tat mentionnant l&#8217;absence ou la pr\u00e9sence d&#8217;amiante soit annex\u00e9e au contrat de location lors de sa signature. Cette nouvelle obligation n&#8217;est toutefois pas entr\u00e9e en vigueur \u00e0 ce jour.<\/p>\n<h3><span id=\"Les_obligations_specifiques_au_bailleur_dun_immeubleen_copropriete\">Les obligations sp\u00e9cifiques au bailleur d\u2019un immeuble\u00a0en copropri\u00e9t\u00e9<\/span><\/h3>\n<p>Lorsque le logement lou\u00e9 est situ\u00e9 dans un immeuble collectif, le bailleur est tenu de certaines obligations d\u2019informations vis-\u00e0-vis de ses locataires.<\/p>\n<ul>\n<li>\n<h4><span id=\"Le_Dossier_amiante_parties_privatives_DAPP\">Le Dossier amiante parties privatives (DAPP)<\/span><\/h4>\n<\/li>\n<\/ul>\n<p>Concernant les parties privatives d\u2019une part, le bailleur doit \u00e9tablir un <strong>Dossier amiante parties privatives (DAPP)<\/strong>, pr\u00e9vu \u00e0 l\u2019article <a href=\"https:\/\/www.legifrance.gouv.fr\/affichCodeArticle.do?idArticle=LEGIARTI000024117149&amp;cidTexte=LEGITEXT000006072665\" target=\"_blank\" rel=\"noopener noreferrer\">R 1334-29-4 du Code de la sant\u00e9 publique<\/a>. Ce dossier contient les rapports de rep\u00e9rages que le bailleur est tenu de faire r\u00e9aliser sur les mat\u00e9riaux et produits de la liste A. Celle-ci vise les flocages, calorifugeages et faux plafonds (<a href=\"https:\/\/www.legifrance.gouv.fr\/affichCodeArticle.do?cidTexte=LEGITEXT000006072665&amp;idArticle=LEGIARTI000006910332&amp;dateTexte=&amp;categorieLien=cid\" target=\"_blank\" rel=\"noopener noreferrer\">Article R 1134-16 du Code de la sant\u00e9 publique<\/a>). Contrairement aux autres diagnostics, le DAPP ne doit pas n\u00e9cessairement \u00eatre annex\u00e9 au contrat de location. Cependant, depuis le 5 juin 2011, le propri\u00e9taire doit tenir \u00e0 disposition du locataire le DAPP, si ce dernier en fait la demande, ainsi qu\u2019\u00e0 celle de toute entreprise devant effectuer des travaux dans l\u2019immeuble.<\/p>\n<ul>\n<li>\n<h4><span id=\"Le_Dossier_technique_amiante_DTA\">Le Dossier technique amiante (DTA)<\/span><\/h4>\n<\/li>\n<\/ul>\n<p>Concernant les parties communes d\u2019autre part, le propri\u00e9taire doit constituer et mettre \u00e0 la disposition des locataires un <strong>Dossier technique amiante (DTA)<\/strong> apr\u00e8s avoir proc\u00e9d\u00e9 \u00e0 un rep\u00e9rage des mat\u00e9riaux et produits des listes A et B contenant de l\u2019amiante. Le DTA d\u00e9taille \u00e9galement les mesures \u00e0 mettre en \u0153uvre pour limiter l\u2019exposition des occupants pr\u00e9sents dans le b\u00e2timent et des personnes appel\u00e9es \u00e0 intervenir sur les mat\u00e9riaux ou produits contenant de l\u2019amiante. Il doit r\u00e9pondre \u00e0 des conditions d\u2019impartialit\u00e9 et d\u2019ind\u00e9pendance et avoir souscrit \u00e0 une assurance couvrant ce type d\u2019intervention sp\u00e9cifique.<br \/>\nLes recherches de ces professionnels doivent notamment porter sur les <strong>calorifugeages, les flocages, les faux plafonds<\/strong>. En effet, le propri\u00e9taire bailleur devra veiller p\u00e9riodiquement \u00e0 faire contr\u00f4ler l\u2019\u00e9tat de conservation des mat\u00e9riaux contenant de l\u2019amiante. Ce contr\u00f4le doit \u00eatre effectu\u00e9 tous les trois ans, jusqu\u2019\u00e0 d\u00e9contamination.<br \/>\nEn cas de pr\u00e9sence d\u2019amiante, le propri\u00e9taire doit tenir le DAPP \u00e0\u00a0la disposition des occupants des parties privatives et de toute personne\u00a0physique ou morale amen\u00e9e \u00e0 organiser ou effectuer des\u00a0travaux dans l\u2019immeuble.<\/p>\n<h3><span id=\"Sanction_du_defaut_de_realisation_dun_diagnostic_amiante\">Sanction du d\u00e9faut de r\u00e9alisation d\u2019un diagnostic amiante<\/span><\/h3>\n<p>Le d\u00e9faut de mise \u00e0 jour et de mise \u00e0 disposition des DAPP et DTA par le bailleur constitue une <strong>violation de son obligation d\u2019information<\/strong>. Celle-ci est constitutive d\u2019une contravention de 5<sup>e<\/sup> classe, sanctionn\u00e9e par <a href=\"https:\/\/www.legifrance.gouv.fr\/affichCodeArticle.do?cidTexte=LEGITEXT000006070719&amp;idArticle=LEGIARTI000006417256\" target=\"_blank\" rel=\"noopener noreferrer\">l\u2019article 131-13 du Code p\u00e9nal<\/a>, pr\u00e9voyant une amende de 1\u00a0500 euros.<br \/>\nD\u2019autre part, le pr\u00e9fet peut\u00a0d\u2019enjoindre au propri\u00e9taire de faire \u00e9tablir le diagnostic d\u2019amiante dans un d\u00e9lai qu\u2019il arr\u00eate.
