Ainsi, selon la Cour de cassation, le consentement donn\u00e9 \u00e0 la convention de rupture sous harc\u00e8lement moral n\u2019est pas valable, puisqu\u2019il n\u2019y a pas de v\u00e9ritable libert\u00e9 de consentement (Arr\u00eat de la chambre sociale de la Cour de cassation du 30 janvier 2013 11-22.332).<\/p>\n<p>Du moment o\u00f9 la libert\u00e9 de consentement est respect\u00e9e, la convention de rupture est m\u00eame valable pour la rupture conventionnelle d\u2019un contrat de travail \u00e0 l\u2019occasion d\u2019un arr\u00eat long de maladie (arr\u00eat de la chambre sociale de la cour de cassation du 30 septembre 2013 12-19.711).<\/p>\n<h2 style=\"text-align: justify;\"><span id=\"Est-ce_qu8217une_erreur_de_lemployeur_permet_de_rendre_nulle_une_rupture_conventionnelle\">Est-ce qu&#8217;une erreur de l\u2019employeur permet de rendre nulle une rupture conventionnelle ?<\/span><\/h2>\n<p style=\"text-align: justify;\">Pas dans tous les cas.<\/p>\n<p>Tout d\u2019abord, si un employeur d\u2019une entreprise ne disposant pas d\u2019institution repr\u00e9sentative du personnel, n\u2019informe pas son employ\u00e9 de la possibilit\u00e9 qu\u2019il a de se faire assister lors des entretiens de formation de la convention de rupture, la convention n\u2019est pas nulle (Cass. soc., 29 janvier 2014, num\u00e9ro 12-27.594).<\/p>\n<p>Ensuite, la cour de cassation a \u00e9galement d\u00e9clar\u00e9 qu\u2019une erreur de la part de l\u2019employeur dans la convention de rupture quant \u00e0 la mention de la date d\u2019expiration du d\u00e9lai de quinze jours pour exercer le droit de r\u00e9tractation ne permet pas l\u2019annulation de la convention si cette erreur ne vicie pas le consentement des parties ni les prive d\u2019exercer le droit en question (Cass. soc., 29 janvier 2014, num\u00e9ro 12-24.539).<\/p>\n<h2 style=\"text-align: justify;\"><span id=\"Est-ce_que_lon_peut_prevoir_une_clause_refusant_par_avance_de_contester_la_rupture_dans_la_convention\">Est-ce que l\u2019on peut pr\u00e9voir une clause refusant par avance de contester la rupture dans la convention ?<\/span><\/h2>\n<p style=\"text-align: justify;\">Une telle clause serait r\u00e9put\u00e9e non \u00e9crite selon un arr\u00eat de la chambre sociale de la Cour de cassation (Cass. soc., 26 juin 2013, num\u00e9ro 12-15.208).<\/p>\n<h2 style=\"text-align: justify;\"><span id=\"Est-ce_quil_existe_un_delai_entre_le_dernier_entretien_et_la_signature_de_la_rupture_conventionnelle\">Est-ce qu\u2019il existe un d\u00e9lai entre le dernier entretien et la signature de la rupture conventionnelle ?<\/span><\/h2>\n<p style=\"text-align: justify;\">Non, selon la Cour de cassation, il n\u2019y a pas de d\u00e9lai l\u00e9gal entre l\u2019entretien et la signature de la convention (Cass. soc., 3 juillet 2013, n\u00b0 12-19.268).<\/p>\n\n<div class=\"kk-star-ratings\n     kksr-valign-bottom     kksr-align-left    \"\n    data-payload=\"{&quot;align&quot;:&quot;left&quot;,&quot;id&quot;:&quot;881&quot;,&quot;slug&quot;:&quot;default&quot;,&quot;valign&quot;:&quot;bottom&quot;,&quot;reference&quot;:&quot;auto&quot;,&quot;count&quot;:&quot;2&quot;,&quot;readonly&quot;:&quot;&quot;,&quot;score&quot;:&quot;5&quot;,&quot;best&quot;:&quot;5&quot;,&quot;gap&quot;:&quot;5&quot;,&quot;greet&quot;:&quot;Rate this post&quot;,&quot;legend&quot;:&quot;5\\\/5 - (2 votes)&quot;,&quot;size&quot;:&quot;24&quot;,&quot;width&quot;:&quot;142.5&quot;,&quot;_legend&quot;:&quot;{score}\\\/{best} - ({count} {votes})&quot;}\">\n    \n<div class=\"kksr-stars\">\n    \n<div class=\"kksr-stars-inactive\">\n            <div class=\"kksr-star\" data-star=\"1\" style=\"padding-right: 5px\">\n            \n\n<div class=\"kksr-icon\" style=\"width: 24px;
