Elle s\u2019\u00e9tend de la <a href=\"https:\/\/www.legalife.fr\/modele\/lettre-de-notification-de-licenciement\/\">notification du licenciement<\/a> par l\u2019employeur au d\u00e9part effectif du salari\u00e9. En effet, lors du licenciement, le salari\u00e9 demeure dans l\u2019entreprise un certain temps. Il continue ainsi \u00e0 travailler et \u00e0 percevoir sa r\u00e9mun\u00e9ration.\u00a0<a href=\"https:\/\/www.legalife.fr\/guides-juridiques\/fin-du-contrat-de-travail-tout-sur-le-preavis\/\">Tout salari\u00e9 licenci\u00e9 est dans l\u2019obligation d\u2019effectuer son pr\u00e9avis<\/a>. Ce principe est toutefois att\u00e9nu\u00e9 lorsque que l\u2019employeur l\u2019en dispense ou s&#8217;il s&#8217;agit\u00a0d\u2019un <a href=\"https:\/\/www.legalife.fr\/guides-juridiques\/legere-simple-grave-lourde-comment-definir-la-faute-du-salarie\/\">licenciement pour faute grave, faute lourde ou inaptitude<\/a>.\u00a0Selon l\u2019anciennet\u00e9 du salari\u00e9, le pr\u00e9avis peut durer de 6 mois \u00e0 plus de 2 ans.<\/p>\n<h3><span id=\"Quest-ce_quune_clause_de_mobilite\">Qu\u2019est-ce qu\u2019une clause de mobilit\u00e9 ?<\/span><\/h3>\n<p>La\u00a0<a href=\"https:\/\/www.legalife.fr\/guides-juridiques\/clause-de-mobilite-contrat-de-travail\/\">clause de mobilit\u00e9<\/a> contenue le plus souvent dans le contrat de travail stipule que le salari\u00e9 accepte que son lieu de travail puisse \u00eatre modifi\u00e9 pendant l\u2019exercice de ses fonctions. Pour \u00eatre valable, cette clause doit sp\u00e9cifier pr\u00e9cis\u00e9ment la zone g\u00e9ographique de mutation. Il s&#8217;agit par exemple du\u00a0d\u00e9partement, de la r\u00e9gion ou de l\u2019ensemble du territoire. Elle\u00a0doit aussi, si elle est activ\u00e9e, correspondre \u00e0 un besoin r\u00e9el de l\u2019entreprise.\u00a0Ces conditions \u00e9tant r\u00e9unies, le salari\u00e9 \u00e0 qui la mobilit\u00e9 est notifi\u00e9e ne peut s\u2019y opposer. Le refus n&#8217;est possible que dans des situations\u00a0pr\u00e9cises. C&#8217;est le cas si la mutation entraine une baisse de la r\u00e9mun\u00e9ration, une atteinte \u00e0 sa vie personnelle et familiale ou encore si le salari\u00e9 est pr\u00e9venu trop tardivement.<\/p>\n<h2><span id=\"Quels_sont_les_faits\">Quels sont les faits ?<\/span><\/h2>\n<p>Dans cette affaire de pr\u00e9avis et clause de mobilit\u00e9, un technicien support technique travaillant \u00e0 Antibes a fait l\u2019objet d\u2019un licenciement pour refus d\u2019application de la clause de mobilit\u00e9 stipul\u00e9e dans son contrat de travail.<\/p>\n<p>En effet, l\u2019employeur \u00a0souhaitait d\u00e9m\u00e9nager son activit\u00e9 en Ile-de-France, \u00e0 Asni\u00e8res-sur-Seine. Il avait donc activ\u00e9\u00a0ladite clause en vertu de son pouvoir de direction. Face au refus du salari\u00e9, il avait alors entam\u00e9 une proc\u00e9dure de licenciement pour cause r\u00e9elle et s\u00e9rieuse. Il avait ainsi pr\u00e9vu qu\u2019il devrait effectuer son pr\u00e9avis au nouveau si\u00e8ge de l\u2019activit\u00e9.<\/p>\n<h2><span id=\"Quelle_est_la_solution_adoptee_par_les_juges\">Quelle est la solution adopt\u00e9e par les juges ?<\/span><\/h2>\n<p>Contestant les conditions d\u2019ex\u00e9cution du pr\u00e9avis, le salari\u00e9 agit en justice pour demander une somme d\u2019argent \u00e0 titre d\u2019indemnit\u00e9 compensatrice de pr\u00e9avis.<\/p>\n<p>Il esp\u00e8re convaincre du comportement contradictoire de l\u2019employeur. En effet, il estime que l\u2019employeur l\u2019a plac\u00e9 dans l\u2019impossibilit\u00e9 d\u2019ex\u00e9cuter son pr\u00e9avis en exigeant qu\u2019il soit effectu\u00e9 \u00e0 Asni\u00e8res, alors que la cause du licenciement \u00e9tait justement le refus de travailler \u00e0 cet endroit.<\/p>\n<ul>\n<li>Le Conseil des prud\u2019hommes consid\u00e8re que le licenciement est valable mais que les exigences relatives au pr\u00e9avis justifient de condamner l\u2019employeur \u00e0 verser une indemnit\u00e9 compensatrice de cong\u00e9s pay\u00e9s.<\/li>\n<li>L\u2019employeur combat cette d\u00e9cision devant la Cour d\u2019appel d\u2019Aix-en-Provence qui confirme la d\u00e9cision de premi\u00e8re instance.<\/li>\n<li>L\u2019employeur forme alors un pourvoi en cassation pour contester devant la Haute Juridiction la condamnation au paiement d\u2019indemnit\u00e9s.<\/li>\n<\/ul>\n<p>La Cour de cassation donne raison \u00e0 l\u2019employeur. Il a le pouvoir de d\u00e9cider du lieu d\u2019ex\u00e9cution du pr\u00e9avis de licenciement.<\/p>\n<p>Non seulement le licenciement est justifi\u00e9, le refus d\u2019\u00eatre mut\u00e9 constituant une <a href=\"https:\/\/www.legalife.fr\/guides-juridiques\/la-cause-reelle-et-serieuse-du-licenciement\/\">cause r\u00e9elle et s\u00e9rieuse<\/a> en pr\u00e9sence d\u2019une clause de mobilit\u00e9 valide, mais toute contestation du salari\u00e9 quant au lieu d\u2019ex\u00e9cution du pr\u00e9avis le rend responsable de l\u2019inex\u00e9cution de ce dernier.
