Elle lui permet d\u2019acqu\u00e9rir en priorit\u00e9 des biens immobiliers situ\u00e9s dans une zone d\u00e9termin\u00e9e. Le cas \u00e9ch\u00e9ant, elle se substitue \u00e0 l\u2019acqu\u00e9reur dans une vente portant sur un tel bien aux m\u00eames conditions.<\/p>\n<p style=\"text-align: justify;\">Le droit de pr\u00e9emption urbain a pour objet de permettre aux collectivit\u00e9s locales d\u2019acqu\u00e9rir certains terrains. Ce de mani\u00e8re \u00e0\u00a0favoriser l\u2019am\u00e9nagement de leur collectivit\u00e9. Cela signifie que les terrains doivent \u00eatre acquis en vue de mettre en \u0153uvre un projet urbain, une politique locale de l\u2019habitat. Mais aussi\u00a0de favoriser le d\u00e9veloppement des loisirs et du tourisme, de r\u00e9aliser des \u00e9quipements collectifs ou des locaux de recherche ou d&#8217;enseignement sup\u00e9rieur, de lutter contre l&#8217;insalubrit\u00e9 et l&#8217;habitat indigne ou dangereux, de permettre le renouvellement urbain. Ou encore de sauvegarder ou mettre en valeur le patrimoine b\u00e2ti ou non b\u00e2ti et les espaces naturels.<\/p>\n<h2 style=\"text-align: justify;\"><span id=\"Quand_peut-on_etre_confronte_a_un_droit_de_preemption_urbain\">Quand peut-on \u00eatre confront\u00e9 \u00e0 un droit de pr\u00e9emption urbain ?<\/span><\/h2>\n<p style=\"text-align: justify;\">Le droit de pr\u00e9emption urbain intervient dans le cadre d&#8217;une vente immobili\u00e8re. Il peut \u00eatre exerc\u00e9 par des communes dot\u00e9es d\u2019un plan local d\u2019urbanisme ou d\u2019un plan d\u2019occupation des sols rendu public. Ou par des \u00e9tablissements publics de coop\u00e9ration intercommunale sur tout ou partie des zones urbaines, \u00e0 urbaniser ou d\u2019urbanisation future.<\/p>\n<p style=\"text-align: justify;\">Si le bien immobilier faisant l\u2019objet de votre compromis de vente fait partie d\u2019une telle zone, sachez qu\u2019il peut donc faire l\u2019objet de l\u2019exercice d\u2019un droit de pr\u00e9emption. Le Code de l&#8217;urbanisme pr\u00e9voit de nombreuses exceptions \u00e0 l&#8217;application du DPU, notamment \u00e0 l&#8217;<a href=\"http:\/\/www.legifrance.gouv.fr\/affichCodeArticle.do?cidTexte=LEGITEXT000006074075&amp;idArticle=LEGIARTI000006815057&amp;dateTexte=&amp;categorieLien=cid\" target=\"_blank\">article L211-4<\/a>. Apr\u00e8s avoir v\u00e9rifi\u00e9 si le bien \u00e9tait soumis \u00e0 un droit de pr\u00e9emption, c\u2019est lui qui, le cas \u00e9ch\u00e9ant, enverra une d\u00e9claration d\u2019intention d\u2019ali\u00e9ner, conform\u00e9ment \u00e0 un mod\u00e8le pr\u00e9vu \u00e0 l\u2019<a href=\"http:\/\/www.legifrance.gouv.fr\/affichCodeArticle.do?cidTexte=LEGITEXT000006074075&amp;idArticle=LEGIARTI000006813831&amp;dateTexte=&amp;categorieLien=cid\">article A213-1 du Code de l\u2019urbanisme<\/a>, au maire de la commune au sein de laquelle se trouve le bien. Cette d\u00e9claration doit comporter le prix et les conditions de la vente. Elle peut \u00eatre transmise par lettre recommand\u00e9e avec accus\u00e9 de r\u00e9ception, ou remise en main propre.<\/p>\n<h3><span id=\"Le_delai_dexercice_du_droit_de_preemption_urbain_apres_signature_du_compromis_de_vente\">Le d\u00e9lai d\u2019exercice du droit de pr\u00e9emption urbain apr\u00e8s signature du compromis de vente<\/span><\/h3>\n<p style=\"text-align: justify;\">Une fois inform\u00e9, le titulaire du droit de pr\u00e9emption urbain dispose d\u2019un d\u00e9lai de deux mois pour faire part de sa d\u00e9cision d\u2019exercer ou non son droit de pr\u00e9emption. Plusieurs cas sont alors envisageables :<\/p>\n<ul>\n<li style=\"text-align: justify;\"><span style=\"text-decoration: underline;\">La commune renonce \u00e0 exercer son droit de pr\u00e9emption<\/span>. Elle peut alors informer express\u00e9ment le notaire ou le vendeur de sa d\u00e9cision.<\/li>\n<li style=\"text-align: justify;\"><span style=\"text-decoration: underline;\">La commune ne r\u00e9agit pas dans le d\u00e9lai de deux mois<\/span>. Elle renonce alors tacitement \u00e0 exercer son droit de pr\u00e9emption.<\/li>\n<li style=\"text-align: justify;\"><span style=\"text-decoration: underline;\">La commune d\u00e9cide d\u2019acqu\u00e9rir le bien au prix et aux conditions indiqu\u00e9es dans la d\u00e9claration d\u2019intention d\u2019ali\u00e9ner<\/span>. La vente pourra donc\u00a0\u00eatre d\u00e9finitivement conclue.<\/li>\n<li style=\"text-align: justify;\"><span style=\"text-decoration: underline;\">Elle\u00a0d\u00e9cide d\u2019acqu\u00e9rir le bien \u00e0 un autre prix que celui indiqu\u00e9, et manifeste son intention de saisir le juge de l\u2019expropriation en cas de refus du vendeur<\/span>. Le vendeur dispose alors d\u2019un d\u00e9lai de deux mois pour r\u00e9pondre. Il peut accepter de conclure la vente \u00e0 ce prix, renoncer \u00e0 vendre le bien, ou refuser de vendre le bien \u00e0 un autre prix que celui fix\u00e9 dans la d\u00e9claration d\u2019intention d\u2019ali\u00e9ner. Le juge de l\u2019expropriation sera alors saisi dans ce dernier cas.<\/li>\n<\/ul>\n<h2 style=\"text-align: justify;\"><span id=\"Les_consequences_de_lexercice_du_droit_de_preemption_urbain_apres_la_signature_dun_compromis_de_vente\">Les cons\u00e9quences de l\u2019exercice du droit de pr\u00e9emption urbain apr\u00e8s la signature d\u2019un compromis de vente<\/span><\/h2>\n<p style=\"text-align: justify;\">Lorsque le titulaire du droit de pr\u00e9emption d\u00e9cide de l\u2019exercer, la vente est conclue. Le compromis de vente est donc caduc du fait de la r\u00e9alisation de la condition suspensive pr\u00e9vue \u00e0 l&#8217;acte. Celle-ci \u00e9tait en effet le non exercice du droit de pr\u00e9emption. Or, ce droit a \u00e9t\u00e9 exerc\u00e9.<\/p>\n<p style=\"text-align: justify;\">L\u2019acte de vente doit \u00eatre r\u00e9alis\u00e9 dans les 3 mois. Le paiement du prix est alors effectu\u00e9 dans les 4 mois suivant soit la d\u00e9cision d\u2019acqu\u00e9rir, soit la d\u00e9cision d\u2019expropriation, soit le jugement d\u2019adjudication selon le cas. A d\u00e9faut, le vendeur redevient alors libre de vendre son bien \u00e0 un tiers.<\/p>\n<h2 style=\"text-align: justify;\"><span id=\"Les_sanctions_et_la_responsabilite_en_cas_dirregularite_dans_la_purge_du_droit_de_preemption_urbain\">Les sanctions et la responsabilit\u00e9 en cas d\u2019irr\u00e9gularit\u00e9 dans la purge du droit de pr\u00e9emption urbain<\/span><\/h2>\n<p style=\"text-align: justify;\">A d\u00e9faut de respect de la proc\u00e9dure, la commune peut demander la nullit\u00e9 de la vente.
