Il lui permet alors d\u00e9cider de revenir ou non sur sa <a href=\"https:\/\/www.legalife.fr\/guides-juridiques\/comment-signer-un-compromis-de-vente\/\">signature du compromis de vente<\/a>.<\/p>\n<p style=\"text-align: justify;\">Ce d\u00e9lai est un d\u00e9lai l\u00e9gal, d\u2019<a href=\"https:\/\/www.legalife.fr\/guides-juridiques\/lexique-juridique\/ordre-public\/\" target=\"_blank\">ordre public<\/a>. On ne peut y d\u00e9roger de quelque fa\u00e7on que ce soit.<\/p>\n<h2 style=\"text-align: justify;\"><span id=\"Comment_calculer_le_delai_de_retractation\">Comment calculer le d\u00e9lai de r\u00e9tractation\u00a0?<\/span><\/h2>\n<p style=\"text-align: justify;\">La loi Macron a fait passer le d\u00e9lai, auparavant de 7 jours, \u00e0 10 jours.<\/p>\n<p style=\"text-align: justify;\">Le d\u00e9lai de r\u00e9tractation commence \u00e0 courir \u00e0 partir du lendemain de la signature de l\u2019acte et de sa remise en mains propres si le compromis a \u00e9t\u00e9 fait devant un notaire ou de la lettre recommand\u00e9e si le compromis r\u00e9sulte d\u2019un acte sous seing priv\u00e9.<\/p>\n<p style=\"text-align: justify;\"><span style=\"text-decoration: underline;\">Cas particulier\u00a0<\/span>: dans l\u2019hypoth\u00e8se o\u00f9 le dixi\u00e8me jour du d\u00e9lai est un jour f\u00e9ri\u00e9 ou un jour ch\u00f4m\u00e9, la fin du d\u00e9lai est report\u00e9e au premier jour ouvrable suivant. Une circonstance impr\u00e9vue vous emp\u00eache de respecter votre engagement\u00a0?<\/p>\n<p style=\"text-align: justify;\">Le d\u00e9lai de r\u00e9tractation vous offre une occasion de revenir sur votre engagement. Il sert \u00e0 pr\u00e9venir et \u00e0 s\u00e9curiser l\u2019acqu\u00e9reur dans ses choix.<\/p>\n<p style=\"text-align: justify;\">Pour acter de sa r\u00e9tractation dans le d\u00e9lai imparti, il suffit d\u2019envoyer au vendeur du bien immobilier une lettre recommand\u00e9e avec accus\u00e9 de r\u00e9ception. Elle mentionne simplement\u00a0votre d\u00e9sir de ne pas poursuivre la vente. Le cachet de la poste fait foi concernant la date et le respect du d\u00e9lai.<\/p>\n<p style=\"text-align: justify;\"><span style=\"text-decoration: underline;\"><strong>La r\u00e9tractation n\u2019a pas \u00e0 \u00eatre motiv\u00e9e<\/strong><\/span>. Il vous suffit simplement de dire que vous revenez sur le compromis de vente. De m\u00eame, personne ne peut vous obliger \u00e0 payer quoi que ce soit pour votre r\u00e9tractation dans le d\u00e9lai.<\/p>\n<h2 style=\"text-align: justify;\"><span id=\"Le_vendeur_du_bien_beneficie_t-il_egalement_dun_droit_de_retractation\">Le vendeur du bien b\u00e9n\u00e9ficie t-il \u00e9galement d\u2019un droit de r\u00e9tractation ?<\/span><\/h2>\n<p style=\"text-align: justify;\">Non. Pourtant, le compromis de vente est une promesse de vente synallagmatique. Cela signifie qu\u2019elle lie les parties en ce qu\u2019elles sont d\u2019accord \u00e0 la fois pour vendre et pour acheter. Celles-ci peuvent concerner notamment la vente forc\u00e9e du bien. Cette solution est vraiment extr\u00eame. Les juges sont donc frileux \u00e0 la mettre en pratique, donc son application reste assez rare. En revanche, l\u2019ex\u00e9cution forc\u00e9e n\u2019est pas possible lorsque le compromis explicite clairement que la vente ne sera parfaite qu\u2019avec la <a href=\"https:\/\/www.legalife.fr\/guides-juridiques\/signer-un-acte-de-vente-immobilier-chez-un-notaire\/\">signature d&#8217;un acte authentique de vente immobilier<\/a>. La partie qui souhaite se r\u00e9tracter peut \u00e9galement devoir attribuer des dommages et int\u00e9r\u00eats suite \u00e0 la r\u00e9solution de la vente devant un tribunal.<\/p>\n<p style=\"text-align: justify;\">Au del\u00e0 de l\u2019aspect judiciaire, le d\u00e9p\u00f4t de garantie ne vous sera pas rembours\u00e9 lors de la r\u00e9tractation hors d\u00e9lai. Dans le cadre d\u2019une promesse unilat\u00e9rale de vente, c\u2019est le m\u00eame syst\u00e8me\u00a0: vous perdez l\u2019indemnit\u00e9 d\u2019immobilisation pay\u00e9e au moment de la signature de la promesse.<\/p>\n<p style=\"text-align: justify;\">Enfin, les parties peuvent pr\u00e9voir, pour pr\u00e9venir ce genre de situation, une clause de d\u00e9dit dans le compromis de vente. Cette derni\u00e8re permet la r\u00e9tractation, hors d\u00e9lai, par le versement d\u2019une indemnit\u00e9.
