Ou encore d\u00e9range le voisinage par son comportement irrespectueux ou par la pr\u00e9sence fr\u00e9quente de nombreux invit\u00e9s bruyants. Il est n\u00e9cessaire de savoir comment r\u00e9agir.<\/p>\n<h2 style=\"text-align: justify;\"><span id=\"Que_faire_en_cas_de_loyer_impaye\">Que faire en cas de loyer impay\u00e9 ?<\/span><\/h2>\n<p class=\"row baseline--default\" style=\"text-align: justify;\">Si votre locataire n\u2019est pas r\u00e9gulier dans le paiement de son loyer, vous pouvez tout d\u2019abord lui faire parvenir\u00a0<a href=\"https:\/\/www.legalife.fr\/document\/avis-decheance-de-loyer\">un avis d\u2019\u00e9ch\u00e9ance de loyer<\/a>. Ce document vous permet de lui rappeler la date du paiement du loyer et le montant d\u00fb.<\/p>\n<p style=\"text-align: justify;\">Si votre locataire ne s\u2019acquitte toujours pas de son loyer, deux situations sont possibles.<\/p>\n<p style=\"text-align: justify;\">Premi\u00e8re hypoth\u00e8se\u00a0: une clause r\u00e9solutoire a \u00e9t\u00e9 ins\u00e9r\u00e9e dans le bail, stipulant que le bailleur peut r\u00e9silier le bail en cas de manquement du locataire \u00e0 ses obligations (et notamment le paiement du loyer). Dans ce cas, il est possible pour le bailleur de faire constater le manquement en justice et d\u2019obtenir la r\u00e9siliation du bail.<\/p>\n<p style=\"text-align: justify;\">Deuxi\u00e8me solution possible, aucune clause ex\u00e9cutoire n\u2019a \u00e9t\u00e9 ins\u00e9r\u00e9e dans le bail. Le bailleur peut tout de m\u00eame in fine r\u00e9silier le bail, mais il doit suivre une proc\u00e9dure plus contraignante. Il doit faire parvenir \u00e0 son locataire mais aussi \u00e0 sa caution, le cas \u00e9ch\u00e9ant, un commandement de payer avant de pouvoir engager une proc\u00e9dure judiciaire.<\/p>\n<h2 style=\"text-align: justify;\"><span id=\"Comment_se_garantir_contre_deventuelles_degradations_du_bien_immobilier_loue\">Comment se garantir contre d\u2019\u00e9ventuelles d\u00e9gradations du bien immobilier lou\u00e9 ?<\/span><\/h2>\n<p class=\"row baseline--default\" style=\"text-align: justify;\">Il est possible de demander au locataire de verser un d\u00e9p\u00f4t de garantie.<\/p>\n<p style=\"text-align: justify;\">Celui-ci diff\u00e8re de la caution en ce qu\u2019il constitue une s\u00e9curit\u00e9 en cas de manquement du locataire \u00e0 ses obligations locatives (r\u00e9parations par exemple). Le montant du d\u00e9p\u00f4t de garantie doit imp\u00e9rativement figurer dans le bail.
