Or, la jurisprudence n&#8217;est\u00a0pas toujours convergente et l\u2019appr\u00e9ciation se fait donc\u00a0au cas par cas. Il est ainsi difficile de donner une d\u00e9finition pr\u00e9cise du motif l\u00e9gitime et s\u00e9rieux.<\/p>\n<p style=\"text-align: justify;\">Dans tous les cas, ce motif ne sous-entend pas forc\u00e9ment une faute du locataire. Il peut donc provenir du bailleur.<\/p>\n<h2 style=\"text-align: justify;\"><span id=\"Quelques_exemples_de_motifs_qualifies_de_legitimes_et_serieux\">Quelques exemples de motifs qualifi\u00e9s de l\u00e9gitimes et s\u00e9rieux<\/span><\/h2>\n<p class=\"row baseline--default\" style=\"text-align: justify;\">Dans le cas d\u2019une location par un <a href=\"https:\/\/www.legalife.fr\/modele\/bail-a-usage-dhabitation-et-professionnel-bail-mixte\">bail mixte<\/a>\u00a0: le fait, pour le locataire, de ne pas utiliser la partie habitable du bien immobilier ou encore le fait, toujours pour le locataire, d\u2019abandonner la partie habitable pour utiliser l\u2019ensemble du bien \u00e0 des fins professionnelles.<\/p>\n<p style=\"text-align: justify;\">Sur la probl\u00e9matique des travaux\u00a0: la d\u00e9molition de l\u2019immeuble ou la restructuration de l\u2019immeuble accompagn\u00e9e de travaux de r\u00e9novation par le bailleur.<\/p>\n<p style=\"text-align: justify;\">La faute du locataire\u00a0telle que la persistance de l\u2019accrochage du linge aux fen\u00eatres en d\u00e9pit des injonctions du propri\u00e9taire et du local syndical ou son comportement agressif contraire aux r\u00e8gles de bon voisinage.<\/p>\n<p style=\"text-align: justify;\">A l\u2019inverse, n\u2019ont pas \u00e9t\u00e9 qualifi\u00e9s de motifs l\u00e9gitimes et s\u00e9rieux\u00a0:<\/p>\n<ul class=\"classic-list row\" style=\"text-align: justify;\">\n<li class=\"baseline--default\">La vente de l\u2019immeuble en cours de bail, le locataire pouvant rester dans le bien immobilier malgr\u00e9 sa vente.<\/li>\n<li class=\"baseline--default\">La reprise des d\u00e9pendances des locaux lou\u00e9s pour cr\u00e9er un nouveau logement.<\/li>\n<\/ul>\n<h2 style=\"text-align: justify;\"><span id=\"A_qui_envoyer_le_conge_pour_motif_legitime\">A qui envoyer le cong\u00e9 pour motif l\u00e9gitime ?<a href=\"https:\/\/www.legalife.fr\/guides-juridiques\/colocation-en-couple-reglementation\/\"><img loading=\"lazy\" class=\"alignright wp-image-8853\" src=\"https:\/\/d1mxkq1wocxjoy.cloudfront.net\/guides-uploads\/2015\/11\/11115237\/conge%CC%81colocationencouple.png\" alt=\"Cong\u00e9 et colocation en couple\" width=\"397\" height=\"333\" srcset=\"https:\/\/d1mxkq1wocxjoy.cloudfront.net\/guides-uploads\/2015\/11\/11115237\/conge%CC%81colocationencouple.png 940w, https:\/\/d1mxkq1wocxjoy.cloudfront.net\/guides-uploads\/2015\/11\/11115237\/conge%CC%81colocationencouple-300x251.png 300w, https:\/\/d1mxkq1wocxjoy.cloudfront.net\/guides-uploads\/2015\/11\/11115237\/conge%CC%81colocationencouple-768x644.png 768w, https:\/\/d1mxkq1wocxjoy.cloudfront.net\/guides-uploads\/2015\/11\/11115237\/conge%CC%81colocationencouple-810x679.png 810w\" sizes=\"(max-width: 397px) 100vw, 397px\" \/><\/a><\/span><\/h2>\n<p class=\"row baseline--default\" style=\"text-align: justify;\">Si les locataires sont de simples locataires conjoints, sans lien de solidarit\u00e9, chacun d\u2019entre eux doit recevoir une notification du cong\u00e9. A d\u00e9faut, ce dernier ne sera pas applicable aux locataires n\u2019en ayant pas \u00e9t\u00e9 destinataires. Si les locataires sont solidaires, la notification \u00e0 l\u2019un d\u2019entre eux vaut pour tous, mais leur solidarit\u00e9 ne dispense pas le bailleur, d\u2019apr\u00e8s la Cour de cassation, de notifier le cong\u00e9 \u00e0 l\u2019ensemble des locataires.<\/p>\n<p style=\"text-align: justify;\">Si les locataires sont mari\u00e9s ou pacs\u00e9s et que le bailleur en a \u00e9t\u00e9 inform\u00e9, il doit notifier le cong\u00e9 aux deux.<\/p>\n<h2 style=\"text-align: justify;\"><span id=\"Le_conge_pour_motif_legitime_peut-il_etre_donne_a_tous_les_locataires\">Le cong\u00e9 pour motif l\u00e9gitime peut-il \u00eatre donn\u00e9 \u00e0 tous les locataires ?<\/span><\/h2>\n<p class=\"row baseline--default\" style=\"text-align: justify;\">Le bailleur ne peut s\u2019opposer au renouvellement du bail d\u2019un locataire \u00e2g\u00e9 de plus de 70 ans et disposant de ressources \u00e9quivalentes \u00e0 moins d\u2019une fois et demie le SMIC, sauf s\u2019il dispose de la possibilit\u00e9 de le reloger dans un rayon g\u00e9ographique raisonnable.<\/p>\n<p style=\"text-align: justify;\"><span style=\"text-decoration: underline;\"><strong>Attention\u00a0:<\/strong><\/span> pour les baux sign\u00e9s ou reconduits apr\u00e8s le 27 mars 2014, la <a href=\"https:\/\/www.legifrance.gouv.fr\/affichTexte.do?cidTexte=JORFTEXT000028772256&amp;categorieLien=id\" target=\"_blank\">loi Alur<\/a> pr\u00e9voit un abaissement du seuil de l\u2019\u00e2ge du locataire prot\u00e9g\u00e9 \u00e0 65 ans.
