Pourront y \u00eatre pr\u00e9lev\u00e9es, \u00e0 la fin du bail, les sommes n\u00e9cessaires \u00e0 la r\u00e9paration de dommages \u00e9ventuellement caus\u00e9s par le locataire. Une caution est une garantie de paiement du loyer.<\/p>\n<h2 style=\"text-align: justify;\"><span id=\"Le_montant_du_depot_de_garantie\">Le montant du d\u00e9p\u00f4t de garantie<\/span><\/h2>\n<p class=\"row baseline--default\" style=\"text-align: justify;\">Dans le cas d\u2019<a href=\"https:\/\/www.legalife.fr\/document\/bail-dhabitation-meublee\">une location meubl\u00e9e<\/a>, le montant du d\u00e9p\u00f4t de garantie ne peut d\u00e9passer 2 mois de loyer hors charge. Pour\u00a0<a href=\"https:\/\/www.legalife.fr\/document\/bail-dhabitation-non-meublee\">une location non meubl\u00e9e<\/a>, il\u00a0ne peut \u00eatre sup\u00e9rieur \u00e0 1 mois de loyer hors charge. Dans les deux cas, il n\u2019est toutefois pas exigible si le locataire paie plus de 2 mois de loyer d\u2019avance. C&#8217;est le cas par exemple du paiement d\u2019un loyer trimestriel.<\/p>\n<h2 style=\"text-align: justify;\"><span id=\"La_restitution_du_depot_de_garantie\">La restitution du d\u00e9p\u00f4t de garantie<\/span><\/h2>\n<p class=\"row baseline--default\" style=\"text-align: justify;\">Le d\u00e9p\u00f4t de garantie est\u00a0une protection contre des dommages ou un manquement du locataire \u00e0 ses obligations. Il doit donc lui \u00eatre restitu\u00e9 \u00e0 la sortie des lieux si aucune de ces difficult\u00e9s n\u2019a \u00e9t\u00e9 rencontr\u00e9e. Ainsi, si l\u2019\u00e9tat des lieux de sortie correspond \u00e0 l\u2019\u00e9tat des lieux d\u2019entr\u00e9e, le bailleur doit\u00a0reverser au locataire son d\u00e9p\u00f4t. Il dispose d&#8217;un d\u00e9lai de un mois pour le faire.<\/p>\n<p>Par contre, ce d\u00e9lai change lorsque des pr\u00e9l\u00e8vements doivent \u00eatre faits sur le montant du d\u00e9p\u00f4t. Il est alors augment\u00e9 \u00e0 deux mois.<\/p>\n<h2 style=\"text-align: justify;\"><span id=\"Les_elements_pouvant_justifier_une_retenue_sur_le_depot_de_garantie\">Les \u00e9l\u00e9ments pouvant justifier une retenue sur le d\u00e9p\u00f4t de garantie<\/span><\/h2>\n<p class=\"row baseline--default\" style=\"text-align: justify;\">Que la location soit meubl\u00e9e ou non, le bailleur peut retenir des sommes. Il s&#8217;agit de celles correspondant \u00e0 des impay\u00e9s de loyers ou de charges ainsi qu\u2019\u00e0 des d\u00e9gradations sur le d\u00e9p\u00f4t de garantie. Il doit \u00eatre en mesure de justifier les pr\u00e9l\u00e8vements effectu\u00e9s. L\u2019identification des d\u00e9gradations se fait en comparant l\u2019\u00e9tat des lieux d\u2019entr\u00e9e avec celui de sortie.<\/p>\n<p>Toutefois, le locataire ne peut \u00eatre tenu pour responsable de r\u00e9parations rendues n\u00e9cessaires par l\u2019usure, la v\u00e9tust\u00e9, une malfa\u00e7on ou encore un \u00e9v\u00e9nement fortuit ou un cas de force majeur.<\/p>\n<h2 style=\"text-align: justify;\"><span id=\"La_restitution_tardive_du_depot_de_garantie\">La restitution tardive du d\u00e9p\u00f4t de garantie<\/span><\/h2>\n<p class=\"row baseline--default\" style=\"text-align: justify;\">En cas de restitution tardive du d\u00e9p\u00f4t, son montant\u00a0est alors major\u00e9 de 10% de son montant initial par mois de retard.<\/p>\n<p>Cette majoration intervient apr\u00e8s l\u2019envoi du locataire au bailleur d\u2019une <a href=\"https:\/\/www.legalife.fr\/document\/remboursement-du-depot-de-garantie\">mise en demeure de restituer le d\u00e9p\u00f4t<\/a>. Elle lui est transmise par lettre recommand\u00e9e avec accus\u00e9 de r\u00e9ception (LRAR).
