Cette derni\u00e8re obligation s\u2019applique que l\u2019annonce soit pass\u00e9e par un professionnel ou par un particulier et quel que soit la mani\u00e8re dont elle est rendue publique (vitrine d\u2019un professionnel ou voie papier par exemple).<\/p>\n<p>La validit\u00e9 du DPE est de 10 ans \u00e0 compter de sa r\u00e9alisation par l&#8217;expert comp\u00e9tent. Elle s\u2019appr\u00e9cie \u00e0 la date de signature du bail ou au moment de son renouvellement. Le DPE doit \u00eatre r\u00e9alis\u00e9 par un professionnel r\u00e9pondant \u00e0 des exigences de comp\u00e9tences, d\u2019assurance, d\u2019impartialit\u00e9 et d\u2019ind\u00e9pendance. Votre co-contractant pourra vous demander de lui fournir une attestation d&#8217;assurance et un certificat de comp\u00e9tence de la personne qui a r\u00e9alis\u00e9 le diagnostic de performance \u00e9nerg\u00e9tique.<\/p>\n<p>Le DPE reste un document \u00e0 valeur informative, c\u2019est-\u00e0-dire que le locataire ne peut se pr\u00e9valoir de ses informations contre le bailleur. Comme ses pr\u00e9d\u00e9cesseurs, l&#8217;ERP qui int\u00e8gre le risque Radon a une dur\u00e9e de validit\u00e9 de 6 mois. Par ailleurs, les ESRIS r\u00e9alis\u00e9s avant le 3 ao\u00fbt 2018 restent valables dans la limite de ces 6 mois et ne n\u00e9cessitent aucune r\u00e9actualisation.<\/p>\n<p>Cet \u00e9tat devra \u00eatre annex\u00e9 au contrat de bail commercial si le bien immobilier est situ\u00e9 dans une zone couverte par un plan de pr\u00e9vention des risques technologiques, ou par un plan de pr\u00e9vention des risques naturels pr\u00e9visibles ou dans des zones de sismicit\u00e9 d\u00e9finies par d\u00e9cret.<\/p>\n<p>Il est \u00e9tabli en suivant les mod\u00e8les fournis par la pr\u00e9fecture, la sous-pr\u00e9fecture, la mairie ou disponibles sur internet. Les informations qui y sont contenues sont d\u00e9livr\u00e9es par la pr\u00e9fecture. Sa dur\u00e9e de validit\u00e9 est de six mois \u00e0 la date de signature du contrat de bail. Il convient de se rendre sur le site de la pr\u00e9fecture du lieu de situation du local commercial afin d&#8217;avoir toutes les informations utiles concernant les risques naturels, miniers et technologiques.<\/p>\n<p>En cas de manquement du bailleur \u00e0 cette obligation, le locataire peut demander en justice la r\u00e9solution du bail ou la diminution du juillet 1997, qu&#8217;ils appartiennent \u00e0 des personnes priv\u00e9es ou publiques.<\/p>\n<h2><span
