Elle est de nature contractuelle, c\u2019est-\u00e0-dire qu\u2019elle ne d\u00e9coule pas d\u2019une disposition l\u00e9gislative mais de la volont\u00e9 des parties qui se sont mises d\u2019accord sur son contenu lors de la conclusion du bail.<\/p>\n<h2 style=\"text-align: justify;\"><span id=\"Comment_fonctionne_la_clause_resolutoire_du_bail_commercial\">Comment fonctionne la clause r\u00e9solutoire du bail commercial ?<\/span><\/h2>\n<p class=\"row baseline--default\" style=\"text-align: justify;\">La clause r\u00e9solutoire peut \u00eatre activ\u00e9e par le bailleur sous certaines conditions. Tout d\u2019abord, la faute du locataire doit bien avoir \u00e9t\u00e9 pr\u00e9vue dans la clause et elle doit bien concerner un manquement \u00e0 une obligation contenue dans le bail.<\/p>\n<p style=\"text-align: justify;\">La r\u00e9solution du bail commercial ne peut \u00eatre obtenue qu\u2019apr\u00e8s la mise en demeure du locataire de rem\u00e9dier \u00e0 son manquement. Cette mise en demeure doit imp\u00e9rativement \u00eatre faite par un huissier de justice. Elle doit aussi obligatoirement faire conna\u00eetre au locataire les manquements exacts qui lui sont reproch\u00e9s et le fait que le bailleur souhaite mettre en \u0153uvre la clause r\u00e9solutoire si le manquement venait \u00e0 continuer.<\/p>\n<p style=\"text-align: justify;\">Enfin, le locataire dispose d\u2019un d\u00e9lai d\u2019un mois pour mettre fin \u00e0 son manquement avant que le bailleur ne puisse saisir le Tribunal de Grande Instance pour y faire constater le manquement et obtenir la r\u00e9solution du bail commercial.<\/p>\n<h2 style=\"text-align: justify;\"><span id=\"Les_recours_du_locataire_contre_la_mise_en_oeuvre_de_la_clause_resolutoire_du_bail_commercial\">Les recours du locataire contre la mise en \u0153uvre de la clause r\u00e9solutoire du bail commercial<\/span><\/h2>\n<p class=\"row baseline--default\" style=\"text-align: justify;\">La clause r\u00e9solutoire est parfois s\u00e9v\u00e8re et pour \u00e9viter qu\u2019elle ne soit trop au d\u00e9triment du locataire, sa mise en \u0153uvre a \u00e9t\u00e9 encadr\u00e9e d\u2019un grand formalisme pr\u00e9c\u00e9demment d\u00e9taill\u00e9.<\/p>\n<p style=\"text-align: justify;\">De plus, il faut pr\u00e9ciser que si le locataire r\u00e9gularise sa situation dans le d\u00e9lai d\u2019un mois qui lui est imparti, la mise en demeure du bailleur ne produit plus d\u2019effet.<\/p>\n<p style=\"text-align: justify;\">Par ailleurs, toujours dans le d\u00e9lai d\u2019un mois, le locataire peut saisir le juge et demander, en vertu de l\u2019article <a href=\"http:\/\/www.legifrance.gouv.fr\/affichCodeArticle.do?idArticle=LEGIARTI000006222127&amp;cidTexte=LEGITEXT000005634379\" target=\"_blank\">L145-41 du Code de commerce<\/a>, un d\u00e9lai pendant lequel les effets de la clause r\u00e9solutoire seront suspendus.
