Le locataire peut aussi indiquer au bailleur son intention de rompre d\u00e9finitivement le <a href=\"https:\/\/www.legalife.fr\/modele\/bail-commercial\">bail commercial<\/a> \u00e0 son \u00e9ch\u00e9ance.<\/p>\n<p style=\"text-align: justify;\">Dans les deux cas, le locataire devra restituer les clefs du local. Un \u00e9tat des lieux, \u00e0 l\u2019amiable ou r\u00e9alis\u00e9 par un huissier de justice, devra \u00eatre effectu\u00e9. S\u2019il souhaite exercer ce droit, le locataire doit pr\u00e9venir le bailleur dans les six mois pr\u00e9c\u00e9dant l\u2019\u00e9ch\u00e9ance du bail par acte d\u2019huissier.<\/p>\n<p style=\"text-align: justify;\">Le bailleur dispose de trois mois pour apporter une r\u00e9ponse, son silence valant acceptation.<\/p>\n<p style=\"text-align: justify;\">Le renouvellement peut \u00eatre accompagn\u00e9 d\u2019une r\u00e9vision du loyer.<\/p>\n<h2 style=\"text-align: justify;\"><span id=\"La_tacite_prolongation_a_echeance_du_bail_commercial\">La tacite prolongation \u00e0 \u00e9ch\u00e9ance du bail commercial<\/span><\/h2>\n<p class=\"row baseline--default\" style=\"text-align: justify;\">La tacite prolongation arrive si aucune des deux pr\u00e9c\u00e9dentes solutions n\u2019a \u00e9t\u00e9 mise en \u0153uvre.<\/p>\n<p style=\"text-align: justify;\">Ainsi, si aucune des parties (locataire et bailleur) n\u2019a donn\u00e9 cong\u00e9 du bail, et que celui-ci n\u2019a pas \u00e9t\u00e9 explicitement renouvel\u00e9, le bail est tacitement prolong\u00e9.
