N\u00e9anmoins, l\u2019autorisation du bailleur (ou son refus) peut \u00eatre tacite.<\/p>\n<p style=\"text-align: justify;\">Dans tous les cas, elle ne se pr\u00e9sume pas\u00a0: le locataire doit donc en apporter la preuve en cas de litige.<\/p>\n<h2 style=\"text-align: justify;\"><span id=\"Comment_proceder_a_la_sous_location_dans_le_cadre_d8217un_bail_commercial\">Comment proc\u00e9der \u00e0 la sous location dans le cadre d&#8217;un bail commercial ?<\/span><\/h2>\n<p class=\"row baseline--default\" style=\"text-align: justify;\">Avant de signer le <a href=\"https:\/\/www.legalife.fr\/modele\/contrat-de-sous-location-dun-local-commercial\">contrat de sous-location du local\u00a0commercial<\/a>, le locataire doit informer le bailleur de son intention de sous-louer le local, par lettre recommand\u00e9e avec accus\u00e9 de r\u00e9ception ou par acte d\u2019huissier. Il doit obligatoirement mentionner dans cette lettre le loyer de la sous-location et l\u2019identit\u00e9 du sous-locataire. Le bailleur dispose d\u2019un d\u00e9lai de 15 jours pour r\u00e9pondre, attendu que son silence vaut acceptation.<\/p>\n<p style=\"text-align: justify;\">Par la suite, le locataire doit\u00a0<a href=\"https:\/\/www.legalife.fr\/document\/invitation-du-bailleur-a-concourir-a-la-sous-location-dun-local-commercial\">inviter le bailleur \u00e0 prendre part \u00e0 l\u2019acte de sous-location<\/a>. Ce concours permet au bailleur d\u2019\u00eatre mieux inform\u00e9 du contenu du contrat de sous-location. Il dispose de nouveau de 15 jours pour indiquer s\u2019il souhaite ou non participer, sachant, une fois encore, que son silence vaut acceptation.<\/p>\n<p class=\"p1\"><span class=\"s1\"><a class=\"mks_button mks_button_large squared\" href=\"https:\/\/www.legalife.fr\/modele\/invitation-du-bailleur-a-concourir-a-la-sous-location-d-un-local-commercial\/\" target=\"_self\" style=\"color: #FFFFFF; background-color: #ff7e00\" ><i class=\"fa fa-angle-right\"><\/i><b>R\u00e9diger cette proposition de participation \u00e0 la sous location en ligne<\/b><\/a><\/span><\/p>\n<h2 style=\"text-align: justify;\"><span id=\"Quels_sont_les_droits_du_sous-locataire\">Quels sont les droits du sous-locataire ?<\/span><\/h2>\n<p class=\"row baseline--default\" style=\"text-align: justify;\">Le sous-locataire ne peut disposer de plus de droits que le locataire. Ainsi, il doit respecter la destination des locaux \u00e9tablie dans le bail initial. De la m\u00eame fa\u00e7on, si le locataire met fin de fa\u00e7on anticip\u00e9e \u00e0 son bail commercial, la sous-location prendra elle aussi fin de fa\u00e7on anticip\u00e9e. Mais le sous-locataire pourra demander une indemnit\u00e9 au locataire.<\/p>\n<h2 style=\"text-align: justify;\"><span id=\"Quelles_sont_les_relations_entre_le_sous-locataire_et_le_bailleur\">Quelles sont les relations entre le sous-locataire et le bailleur ?<\/span><\/h2>\n<p class=\"row baseline--default\" style=\"text-align: justify;\">Les relations entre le sous-locataire et le bailleur sont g\u00e9n\u00e9ralement peu \u00e9toff\u00e9es. Il faut noter toutefois que le bailleur peut agir contre le sous-locataire pour qu\u2019il paie le loyer principal, mais seulement \u00e0 hauteur de la part que repr\u00e9sente\u00a0la sous-location.<\/p>\n<p style=\"text-align: justify;\">De surcro\u00eet, le sous-locataire pourra, \u00e0 expiration du bail, en demander\u00a0le renouvellement au bailleur si le locataire n\u2019est pas en mesure de le faire.<\/p>\n<h2 style=\"text-align: justify;\"><span id=\"La_sous-location_change-t-elle_les_rapports_entre_le_locataire_et_le_bailleur\">La sous-location change-t-elle les rapports entre le locataire et le bailleur ?<\/span><\/h2>\n<p class=\"row baseline--default\" style=\"text-align: justify;\">Le locataire est responsable des agissements du sous-locataire envers le bailleur.<\/p>\n<p style=\"text-align: justify;\">Par ailleurs, si le loyer de la sous-location est sup\u00e9rieur \u00e0 celui de la location principale, le bailleur dispose d\u2019un droit de r\u00e9ajustement pr\u00e9vu par le Code de commerce.
