La dur\u00e9e minimale d\u2019un bail commercial est de 9 ans en principe. Toutefois, il existe aussi des baux d\u00e9rogatoires dont la dur\u00e9e ne pouvait exc\u00e9der 2 ans et qui peuvent depuis la loi Pinel aller jusqu\u2019\u00e0 3 ans.<\/p>\n<p>N\u00e9anmoins, cette courte dur\u00e9e est contrebalanc\u00e9e par le fait que le locataire ne pourra pas renouveler son bail. Il devra soit quitter les lieux, soit conclure un nouveau bail d\u2019une dur\u00e9e de 9 ans minimum avec l\u2019accord du bailleur pour qu\u2019il reste dans le local lou\u00e9.<\/p>\n<h2 style=\"text-align: justify;\"><span id=\"Conclure_un_bail_commercial_les_elements_principaux\">Conclure un bail commercial : les \u00e9l\u00e9ments principaux<\/span><\/h2>\n<h3 style=\"text-align: justify;\"><span id=\"L8217objet_du_bail_commercial\">L&#8217;objet du bail commercial<\/span><\/h3>\n<p class=\"row baseline--default\" style=\"text-align: justify;\">L\u2019objet du contrat comporte deux facettes. La premi\u00e8re concerne la description des activit\u00e9s qui sont autoris\u00e9es dans le bien immobilier lou\u00e9. Elles d\u00e9pendent de la volont\u00e9 du bailleur mais aussi de la destination du local. Celle-ci est enregistr\u00e9e aupr\u00e8s de la mairie de la localit\u00e9 o\u00f9 est situ\u00e9 le bien. Il est pr\u00e9f\u00e9rable, tant pour le locataire que pour le bailleur, de bien v\u00e9rifier la destination des lieux avant d\u2019y installer une activit\u00e9.<\/p>\n<p>La seconde facette est celle de la description des lieux. Depuis la loi Pinel, un \u00e9tat des lieux doit \u00eatre r\u00e9alis\u00e9, \u00e0 l\u2019amiable entre les parties ou par huissier de justice.<\/p>\n<h3 style=\"text-align: justify;\"><span id=\"Le_loyer_du_bail_commercial\">Le loyer du bail commercial<\/span><\/h3>\n<p class=\"row baseline--default\" style=\"text-align: justify;\">Le loyer peut \u00eatre fixe ou variable. Quand il est variable, il est g\u00e9n\u00e9ralement index\u00e9 sur le chiffre d\u2019affaires du locataire et parfois assorti d\u2019un montant minimal qui sera pay\u00e9 quel que soit le chiffre d\u2019affaires.<\/p>\n<h3 style=\"text-align: justify;\"><span id=\"La_repartition_des_charges_du_bail_commercial\">La r\u00e9partition des charges du bail commercial<\/span><\/h3>\n<p class=\"row baseline--default\" style=\"text-align: justify;\">Pour les baux commerciaux sign\u00e9s apr\u00e8s le 5 novembre 2014, conform\u00e9ment \u00e0 la loi Pinel, une r\u00e9partition l\u00e9gale des charges entre le bailleur et le locataire a \u00e9t\u00e9 instaur\u00e9e.<\/p>\n<h3 style=\"text-align: justify;\"><span id=\"La_revision_du_loyer\">La r\u00e9vision du loyer<\/span><\/h3>\n<p class=\"row baseline--default\" style=\"text-align: justify;\">L\u2019augmentation du loyer ne peut intervenir que de fa\u00e7on triennale (sauf si une augmentation annuelle est pr\u00e9vue dans une clause du bail).
