Cette d\u00e9claration se fait aupr\u00e8s de la mairie o\u00f9 il est situ\u00e9. Si vous disposez d\u2019un local qui n\u2019\u00e9tait jusqu\u2019alors pas affect\u00e9 \u00e0 une activit\u00e9 commerciale, vous pouvez n\u00e9anmoins effectuer un changement d\u2019affectation, toujours aupr\u00e8s de la mairie.<\/p>\n<h2 style=\"text-align: justify;\"><span id=\"Quelle_forme_doit_prendre_le_bail\">Quelle forme doit prendre le bail ?<\/span><\/h2>\n<p class=\"row baseline--default\" style=\"text-align: justify;\">La forme de ce type de\u00a0bail n\u2019est pas encadr\u00e9e par la loi. Il est donc en principe possible de <a href=\"https:\/\/www.legalife.fr\/guides-juridiques\/conclure-un-bail-commercial\/\">conclure un bail commercial<\/a> de mani\u00e8re orale. Toutefois, il est imp\u00e9ratif\u00a0de le passer par \u00e9crit afin de conserver une preuve des \u00e9l\u00e9ments convenus entre locataire et bailleur (loyer, dur\u00e9e du bail, clause de r\u00e9siliation anticip\u00e9e\u2026) et de pr\u00e9voir des clauses particuli\u00e8res, notamment une <a href=\"https:\/\/www.legalife.fr\/guides-juridiques\/clause-resolutoire-bail-commercial\/\">clause r\u00e9solutoire<\/a>. Le bail peut ainsi prendre la forme d&#8217;un <a href=\"https:\/\/www.legalife.fr\/guides-juridiques\/lexique-juridique\/acte-sous-seing-prive\/\">acte sous seing priv\u00e9<\/a> ou d&#8217;un <a href=\"https:\/\/www.legalife.fr\/guides-juridiques\/quest-ce-quun-acte-authentique\/\">acte authentique (devant notaire)<\/a>.<\/p>\n<h2 style=\"text-align: justify;\"><span id=\"Quels_elements_doivent_obligatoirement_figurer_dans_le_bail_commercial\">Quels \u00e9l\u00e9ments doivent obligatoirement figurer dans le bail commercial ?<\/span><\/h2>\n<p class=\"row baseline--default\" style=\"text-align: justify;\">Certains \u00e9l\u00e9ments devant figurer dans le bail sont strictement encadr\u00e9s, tels que\u00a0:<\/p>\n<ul class=\"classic-list row\" style=\"text-align: justify;\">\n<li class=\"row baseline--default\">La dur\u00e9e minimale du bail est en principe de 9 ans. Toutefois, il existe des baux d\u00e9rogatoires qui permettent de ne conclure un bail que pour 3 ans. Il faut cependant noter que ces baux n\u2019ouvrent pas droit au renouvellement du bail commercial pour le locataire.<\/li>\n<li class=\"row baseline--default\">Le montant initial du <a href=\"https:\/\/www.legalife.fr\/guides-juridiques\/revision-loyer-bail-commercial\/\">loyer du bail commercial<\/a> est libre. Toutefois, son augmentation par r\u00e9vision ou lors du renouvellement du bail est strictement encadr\u00e9e (<a href=\"https:\/\/www.legalife.fr\/guides-juridiques\/baux-commerciaux-les-apports-de-la-loi-pinel\/\">voir loi Pinel<\/a>).<\/li>\n<li class=\"row baseline--default\">Un \u00e9tat des lieux doit \u00eatre \u00e9tabli \u00e0 l\u2019entr\u00e9e du locataire dans les lieux et \u00e0 sa sortie. Cet \u00e9tat des lieux doit alors \u00eatre annex\u00e9 au contrat de bail. Il peut \u00eatre r\u00e9alis\u00e9 \u00e0 l\u2019amiable entre le locataire et le bailleur ou par huissier de justice. Dans ce dernier cas, les frais de l\u2019huissier sont alors partag\u00e9s entre le locataire et le bailleur.<\/li>\n<li class=\"row baseline--default\">Le contrat de bail doit \u00e9num\u00e9rer pr\u00e9cis\u00e9ment et limitativement les charges relatives au bien lou\u00e9 et leur r\u00e9partition entre le locataire et le bailleur.<\/li>\n<li class=\"row baseline--default\">Le propri\u00e9taire\u00a0doit \u00e9galement r\u00e9aliser des <a href=\"https:\/\/www.legalife.fr\/guides-juridiques\/diagnostics-techniques-immobiliers-location-bien-commercial\/\">diagnostics techniques obligatoires pour la location d&#8217;un local commercial<\/a> (ex : un \u00e9tat des risques naturels miniers et technologiques).<\/li>\n<li class=\"row baseline--default\">Pour les locaux d\u2019une surface de plus de 2000 m\u00b2, le bail doit comprendre une annexe environnementale relative \u00e0 l\u2019\u00e9nergie consomm\u00e9e et \u00e0 la quantit\u00e9 de d\u00e9chets produite.<\/li>\n<\/ul>\n<h2 style=\"text-align: justify;\"><span id=\"Peut-on_sous_louer_un_localcommercial\">Peut-on sous louer un local\u00a0commercial ?<\/span><\/h2>\n<p>Sous certaines conditions, il est possible au locataire de <a href=\"https:\/\/www.legalife.fr\/guides-juridiques\/sous-location-bail-commercial\/\">sous-louer le bien immobilier commercial<\/a> qu&#8217;il loue en vertu d&#8217;un bail commercial. Ces conditions sont notamment relatives au loyer et \u00e0 l&#8217;information du bailleur.<\/p>\n<h2 style=\"text-align: justify;\"><span id=\"Comment_mettre_fin_a_un_bail_commercial\">Comment mettre fin \u00e0 un bail commercial ?<\/span><\/h2>\n<p class=\"row baseline--default\" style=\"text-align: justify;\">Le bail peut \u00eatre r\u00e9sili\u00e9, \u00e0 son terme ou avant son terme, \u00e0 l\u2019initiative du locataire ou du bailleur.
