Le salari\u00e9 peut-il revenir sur sa d\u00e9cision ?<\/a><\/li><\/ul><\/div>\n<h2 style=\"text-align: justify;\"><span id=\"A_quoi_sert_une_lettre_de_demission_d8217un_salarie\">A quoi sert une lettre de d\u00e9mission d&#8217;un salari\u00e9 ?<\/span><\/h2>\n<p class=\"row baseline--default\" style=\"text-align: justify;\">Une\u00a0<a href=\"https:\/\/www.legalife.fr\/document\/lettre-de-demission-cdi\">lettre de d\u00e9mission<\/a>\u00a0d&#8217;un salari\u00e9 est un document simple, sans encadrement juridique, dans lequel le salari\u00e9 annonce \u00e0 son employeur son intention de d\u00e9missionner du poste qu&#8217;il occupe dans l&#8217;entreprise.<\/p>\n<h2 style=\"text-align: justify;\"><span id=\"Le_salarie_est-il_oblige_d8217envoyer_une_lettre_de_demission\">Le salari\u00e9 est-il oblig\u00e9 d&#8217;envoyer une lettre de d\u00e9mission ?<\/span><\/h2>\n<p class=\"row baseline--default\" style=\"text-align: justify;\">Non, le salari\u00e9 doit simplement indiquer de mani\u00e8re non \u00e9quivoque sa volont\u00e9 de d\u00e9missionner de son poste actuel. Toutefois, s\u2019il exprime cette volont\u00e9 oralement seulement, il sera plus difficile d\u2019apporter la preuve de sa volont\u00e9 non \u00e9quivoque de d\u00e9missionner si n\u00e9cessaire. Ainsi, il est pr\u00e9f\u00e9rable de r\u00e9diger une lettre de d\u00e9mission \u00e0 destination de l&#8217;employeur. La lettre de d\u00e9mission permet aussi de marquer le d\u00e9but de la p\u00e9riode de pr\u00e9avis le cas \u00e9ch\u00e9ant.<\/p>\n<h2 style=\"text-align: justify;\"><span id=\"Un_salarie_peut-il_demissionner_quel_que_soit_son_contrat_de_travail\">Un salari\u00e9 peut-il d\u00e9missionner quel que soit son contrat de travail ?<\/span><\/h2>\n<p class=\"row baseline--default\" style=\"text-align: justify;\">Si le salari\u00e9 est en CDI, il peut rompre son contrat de travail \u00e0 tout moment.<\/p>\n<p style=\"text-align: justify;\">Si le salari\u00e9 est en CDD, en principe, ni l&#8217;employeur ni le salari\u00e9 ne peuvent rompre un contrat de travail \u00e0 dur\u00e9e d\u00e9termin\u00e9e (CDD).<\/p>\n<p style=\"text-align: justify;\">Toutefois, des exceptions ont \u00e9t\u00e9 pr\u00e9vues.<\/p>\n<p style=\"text-align: justify;\">Ainsi, un\u00a0<a href=\"https:\/\/www.legalife.fr\/document\/rupture-anticipee-de-cdd-pour-embauche-externe-en-cdi\">salari\u00e9 peut d\u00e9missionner de son CDD s\u2019il trouve un CDI<\/a>, s\u2019il invoque un cas de force majeur ou dans le cas o\u00f9 son employeur a commis une faute grave ou une faute lourde.<\/p>\n<p style=\"text-align: justify;\">Si un salari\u00e9 fait part \u00e0 son employeur de son intention de d\u00e9missionner sans l\u2019une de ces raisons, les deux parties peuvent convenir \u00e0 l\u2019amiable de la date de rupture du CDD.<\/p>\n<h2 style=\"text-align: justify;\"><span id=\"Le_salarie_doit-il_motiver_sa_decision_de_demissionner\">Le salari\u00e9 doit-il motiver sa d\u00e9cision de d\u00e9missionner ?<\/span><\/h2>\n<p class=\"row baseline--default\" style=\"text-align: justify;\">Le salari\u00e9 n\u2019a pas \u00e0 pr\u00e9ciser dans sa lettre les motifs qui l\u2019ont amen\u00e9 \u00e0 prendre cette d\u00e9cision mais il peut les mentionner s\u2019il le souhaite.<\/p>\n<p style=\"text-align: justify;\">N\u00e9anmoins, si l&#8217;employeur constate que la d\u00e9cision de d\u00e9mission du salari\u00e9 a \u00e9t\u00e9 prise uniquement pour lui nuire et qu\u2019elle est donc abusive, il peut poursuivre le salari\u00e9 en justice pour qu\u2019il soit condamn\u00e9 \u00e0 lui verser des dommages et int\u00e9r\u00eats.<\/p>\n<h2 style=\"text-align: justify;\"><span id=\"Un_preavis_doit-il_etre_respecte_par_le_salarie\">Un pr\u00e9avis doit-il \u00eatre respect\u00e9 par le salari\u00e9 ?<\/span><\/h2>\n<p class=\"row baseline--default\" style=\"text-align: justify;\">Le d\u00e9lai de pr\u00e9avis figure dans les conventions collectives ou est fix\u00e9 par la loi (pour les journalistes, les assistantes maternelles et les repr\u00e9sentants de commerce).<\/p>\n<p style=\"text-align: justify;\">Le salari\u00e9 peut inclure dans sa\u00a0<a href=\"https:\/\/www.legalife.fr\/document\/lettre-de-demission-cdi\">lettre de d\u00e9mission<\/a>\u00a0une demande de dispense de pr\u00e9avis mais l&#8217;employeur n\u2019est pas tenu de l\u2019accepter.<\/p>\n<p style=\"text-align: justify;\">Si l&#8217;employeur l\u2019accepte la demande du salari\u00e9, il doit conclure avec le salari\u00e9 d\u2019une date \u00e0 laquelle son contrat de travail s\u2019arr\u00eatera.<\/p>\n<p style=\"text-align: justify;\">Si l&#8217;employeur refuse, le salari\u00e9 sera tenu de respecter la dur\u00e9e l\u00e9gale du pr\u00e9avis. Toutefois, le salari\u00e9 n\u2019est pas oblig\u00e9 de respecter de pr\u00e9avis s\u2019il d\u00e9missionne pendant une grossesse, pour \u00e9lever un enfant ou en cas de cong\u00e9 pour cr\u00e9ation d\u2019entreprise.<\/p>\n<p style=\"text-align: justify;\"><u>A savoir<\/u>\u00a0: le pr\u00e9avis commence \u00e0 courir \u00e0 partir du moment o\u00f9 la d\u00e9cision du salari\u00e9 a \u00e9t\u00e9 notifi\u00e9e \u00e0 l&#8217;employeur. Ainsi, il est utile que l&#8217;employeur prenne acte de la r\u00e9ception de la lettre de d\u00e9mission du salari\u00e9.<\/p>\n<h2 style=\"text-align: justify;\"><span id=\"L8217employeur_peut-il_refuser_la_demission_d8217un_salarie_Le_salarie_peut-il_revenir_sur_sa_decision\">L&#8217;employeur peut-il refuser la d\u00e9mission d&#8217;un salari\u00e9 ?
