Sauf pour le licenciement \u00e9conomique de plus de 10 salari\u00e9s sur une m\u00eame p\u00e9riode de 30 jours.<\/p>\n<p style=\"text-align: justify;\">L\u2019employ\u00e9 doit \u00eatre r\u00e9guli\u00e8rement convoqu\u00e9 par lettre recommand\u00e9e, ou par lettre remise en mains propres contre d\u00e9charge, au moins 5 jours ouvrables avant ledit entretien. Le courrier doit indiquer le motif du licenciement envisag\u00e9, et les date, lieu et heure de l\u2019entretien.<\/p>\n<p style=\"text-align: justify;\">L\u2019entretien doit se d\u00e9rouler entre un seul salari\u00e9, \u00e9ventuellement assist\u00e9, et l\u2019employeur, lui aussi \u00e9ventuellement assist\u00e9. Et ce, m\u00eame si plusieurs salari\u00e9s sont licenci\u00e9s pour le m\u00eame motif.<\/p>\n<p style=\"text-align: justify;\">Au cours de l\u2019entretien, il doit y avoir un \u00e9change sur les motifs qui ont conduit \u00e0 l\u2019entretien.<\/p>\n<p style=\"text-align: justify;\">L\u2019absence du salari\u00e9 n\u2019a aucune incidence sur la poursuite de la proc\u00e9dure de licenciement.<\/p>\n<h2 style=\"text-align: justify;\"><span id=\"La_notification_du_licenciement\">La notification du licenciement<\/span><\/h2>\n<p class=\"row baseline--default\" style=\"text-align: justify;\">L\u2019employeur qui d\u00e9cide \u00e0 l\u2019issue de l\u2019entretien pr\u00e9alable de licencier le salari\u00e9 doit lui envoyer une lettre de notification de licenciement. Soit par recommand\u00e9 avec accus\u00e9 de r\u00e9ception, soit en lui remettant en mains propres contre d\u00e9charge.<\/p>\n<p style=\"text-align: justify;\">Cette lettre doit obligatoirement contenir tous les motifs propres \u00e0 justifier le licenciement. M\u00eame s\u2019ils avaient \u00e9t\u00e9 convenablement pr\u00e9cis\u00e9s dans la lettre de convocation \u00e0 l\u2019entretien. Au regard de la loi, ces motifs doivent constituer une cause r\u00e9elle et s\u00e9rieuse de licenciement.<\/p>\n<p style=\"text-align: justify;\">Cette lettre ne peut pas \u00eatre envoy\u00e9e avant l\u2019expiration d\u2019un d\u00e9lai de deux jours apr\u00e8s l\u2019entretien.<\/p>\n<p style=\"text-align: justify;\">Il est possible que la convention collective pr\u00e9voie au pr\u00e9alable la consultation d\u2019une commission disciplinaire pour qu\u2019elle donne un avis. Si tel est le cas, c\u2019est une formalit\u00e9 imp\u00e9rative qu\u2019il faudra observer.<\/p>\n<h2 style=\"text-align: justify;\"><span id=\"En_cas_de_violation_de_la_procedure_de_licenciement\">En cas de violation de la proc\u00e9dure de licenciement<\/span><\/h2>\n<p class=\"row baseline--default\" style=\"text-align: justify;\">Il y a violation d\u00e8s qu\u2019il y a manquement aux r\u00e8gles pr\u00e9cit\u00e9es\u00a0: pas de convocation \u00e0 l\u2019entretien, mauvais d\u00e9roulement de l\u2019entretien, non-respect des d\u00e9lais, etc.<\/p>\n<p style=\"text-align: justify;\">\n<\/div>\n<div class=\"cms row-action\">\n<ul>\n<li>Pour un salari\u00e9 ayant au moins 2 ans d\u2019anciennet\u00e9 dans une entreprise d\u2019au moins 11 salari\u00e9s, il aura le droit \u00e0 une indemnit\u00e9 pour irr\u00e9gularit\u00e9 \u00e9quivalent \u00e0 un mois de salaire maximum. En cas de licenciement sans cause r\u00e9elle et s\u00e9rieuse, une autre indemnit\u00e9 pourra s\u2019y ajouter. Cette r\u00e8gle ne vaut pas si la violation de la proc\u00e9dure provient du fait que la convocation \u00e0 l\u2019entretien pr\u00e9alable ne mentionnait pas la possibilit\u00e9 pour le salari\u00e9 de se faire assister\u00a0: dans ce cas, l\u2019indemnit\u00e9 est d\u2019un mois de salaire brut.<\/li>\n<\/ul>\n<ul>\n<li>Pour un salari\u00e9 dont l\u2019anciennet\u00e9 est inf\u00e9rieure \u00e0 2 ans, ou s\u2019il travaille pour une entreprise de moins de 11 salari\u00e9s, l\u2019indemnit\u00e9 d\u00e9pend du pr\u00e9judice subi en raison de l\u2019irr\u00e9gularit\u00e9 de proc\u00e9dure.
