M\u00eame si un <a href=\"https:\/\/www.legalife.fr\/document\/contrat-de-travail-a-duree-indeterminee\">contrat de travail \u00e0 dur\u00e9e ind\u00e9termin\u00e9e<\/a> \u00e0 temps plein ne l\u2019est pas forc\u00e9ment. Une fois sign\u00e9, un tel contrat ne peut \u00eatre modifi\u00e9 que si l\u2019employeur et l\u2019employ\u00e9 y consentent. Il ne peut pas y avoir de modification unilat\u00e9rale d\u2019un contrat de travail.<\/p>\n<p>Un <a href=\"https:\/\/www.legalife.fr\/document\/avenant-au-contrat-de-travail\">avenant au contrat de travail<\/a> peut \u00eatre r\u00e9dig\u00e9 au moment de la modification. A moins que le contrat de travail ne pr\u00e9voit un d\u00e9lai entre la r\u00e9daction de l\u2019avenant et la prise d\u2019effet de l\u2019avenant.<\/p>\n<p>Il est essentiel de consulter l\u2019employ\u00e9 dont le contrat de travail peut \u00eatre modifi\u00e9. Car il devra consentir par \u00e9crit \u00e0 cette modification.\u00a0En effet, m\u00eame si le contrat de travail est oral, toute modification doit passer par un document papier sign\u00e9 par les deux parties.<\/p>\n<h2 style=\"text-align: justify;\"><span id=\"La_modification_imposee_par_lemployeur\">La modification impos\u00e9e par l\u2019employeur<\/span><\/h2>\n<h3 style=\"text-align: justify;\"><\/h3>\n<p class=\"row baseline--default\" style=\"text-align: justify;\">Par principe, l\u2019employeur qui impose une modification du contrat de travail \u00e0 laquelle le salari\u00e9 n\u2019a pas consenti viole ledit contrat de travail.<\/p>\n<p>Cette violation permettrait donc au salari\u00e9 d\u2019engager une action en r\u00e9paration si cette modification impos\u00e9e causait un pr\u00e9judice au travailleur.<\/p>\n<p>Toutefois,\u00a0 m\u00eame si le salari\u00e9 a le droit de s\u2019opposer \u00e0 une modification de son contrat de travail. Ce refus peut constituer un motif de licenciement dans deux cas\u00a0:<\/p>\n<ul class=\"classic-list row\" style=\"text-align: justify;\">\n<li class=\"row baseline--default\">Si des motifs disciplinaires avaient entra\u00eene la modification du contrat de travail, le refus du salari\u00e9 peut justifier son licenciement\u00a0;<\/li>\n<li class=\"row baseline--default\">Si des difficult\u00e9s \u00e9conomiques mena\u00e7ant l\u2019entreprise ont pouss\u00e9 l\u2019employeur \u00e0 vouloir modifier le contrat de travail d\u2019un salari\u00e9, ce dernier peut \u00eatre licenci\u00e9 pour motif \u00e9conomique s\u2019il refuse.<\/li>\n<\/ul>\n<h2 style=\"text-align: justify;\"><span id=\"La_modification_des_conditions_de_travail\">La modification des conditions de travail<\/span><\/h2>\n<h3 style=\"text-align: justify;\"><\/h3>\n<p class=\"row baseline--default\" style=\"text-align: justify;\">Seule la modification des clauses du contrat de travail n\u00e9cessite l\u2019accord du salari\u00e9.
