Les revenus du salari\u00e9 sont remplac\u00e9s par des indemnit\u00e9s journali\u00e8res, vers\u00e9es au-del\u00e0 d\u2019un d\u00e9lai de carence. La S\u00e9curit\u00e9 sociale verse des indemnit\u00e9s journali\u00e8res pour chaque jour calendaire non-travaill\u00e9 en raison de la maladie du salari\u00e9.<\/p>\n<p style=\"text-align: justify;\">Sauf dispositions conventionnelles plus favorables, l\u2019employeur est aussi tenu de verser des indemnit\u00e9s compl\u00e9mentaires sous 4 conditions\u00a0:<\/p>\n<ul class=\"classic-list row\" style=\"text-align: justify;\">\n<li class=\"row baseline--default\">Le salari\u00e9 malade lui a transmis son certificat m\u00e9dical sous 48 heures\u00a0;<\/li>\n<li class=\"row baseline--default\">Le salari\u00e9 b\u00e9n\u00e9ficie des indemnit\u00e9s journali\u00e8res vers\u00e9es par la S\u00e9curit\u00e9 Sociale\u00a0;<\/li>\n<li class=\"row baseline--default\">Au jour du d\u00e9part en cong\u00e9 maladie, le salari\u00e9 pouvait justifier d\u2019un an d\u2019anciennet\u00e9 dans l\u2019entreprise\u00a0; et<\/li>\n<li class=\"row baseline--default\">Le salari\u00e9 est soign\u00e9 dans l\u2019Espace Economique Europ\u00e9en, dont la France fait partie.<\/li>\n<\/ul>\n<h2 style=\"text-align: justify;\"><span id=\"Les_jours_de_carence\">Les jours de carence<\/span><\/h2>\n<p class=\"row baseline--default\" style=\"text-align: justify;\">Il existe un d\u00e9lai de carence dans la sph\u00e8re priv\u00e9e (qui peut \u00eatre raccourci par convention) : le versement des indemnit\u00e9s journali\u00e8res par l\u2019entreprise ne commence qu\u2019au 8\u00e8me jour (4\u00e8me jour pour la S\u00e9curit\u00e9 Sociale).<\/p>\n<p style=\"text-align: justify;\">Il existe de rares cas pour lesquels le d\u00e9lai de carence n\u2019est pas applicable (ex\u00a0: la reprise de travail entre deux arr\u00eats maladie n\u2019a pas dur\u00e9 48 heures).<\/p>\n<h2 style=\"text-align: justify;\"><span id=\"Le_montant_des_indemnites\">Le montant des indemnit\u00e9s<\/span><\/h2>\n<p class=\"row baseline--default\" style=\"text-align: justify;\">Pendant les 30 premiers jours de cong\u00e9s maladie, le salaire est maintenu \u00e0 hauteur de 90%. Au-del\u00e0 du 30\u00e8me jour, l\u2019employeur n\u2019est plus tenu qu\u2019aux 2\/3, sauf dispositions conventionnelles plus avantageuses. Mais l\u2019employeur ne verse pas des indemnit\u00e9s tout au long du cong\u00e9\u00a0: la dur\u00e9e maximale d\u2019indemnisation d\u00e9pend ensuite de l\u2019anciennet\u00e9 du salari\u00e9 (30 jours \u00e0 90% et 30 jours \u00e0 66% jusqu\u2019\u00e0 5 ans d\u2019anciennet\u00e9\u00a0; 40 jours \u00e0 90% + 40 jours \u00e0 66% entre 6 et 10 ans d\u2019anciennet\u00e9, etc).<\/p>\n<p style=\"text-align: justify;\">Tant qu\u2019il verse des indemnit\u00e9s, l\u2019employeur dispose du pouvoir de faire effectuer, par un m\u00e9decin de son choix, une visite de contr\u00f4le aupr\u00e8s du salari\u00e9 malade.
