{"id":4600,"date":"2015-11-24T12:26:19","date_gmt":"2015-11-24T11:26:19","guid":{"rendered":"https:\/\/www.legalife.fr\/blog\/?p=4600"},"modified":"2018-11-08T10:18:03","modified_gmt":"2018-11-08T09:18:03","slug":"conges-payes-du-salarie","status":"publish","type":"post","link":"https:\/\/www.legalife.fr\/guides-juridiques\/conges-payes-du-salarie\/","title":{"rendered":"Les cong\u00e9s pay\u00e9s du salari\u00e9"},"content":{"rendered":"<p style=\"text-align: justify;\">Tous les salari\u00e9s ont droit \u00e0 des vacances, l&#8217;employeur doit g\u00e9rer au quotidien les vacances de ses diff\u00e9rents salari\u00e9s.<\/p>\n<h2 style=\"text-align: justify;\">Combien de jours de cong\u00e9 pour le salari\u00e9 ?<\/h2>\n<p class=\"row baseline--default\" style=\"text-align: justify;\">Tout salari\u00e9 a droit \u00e0 30 jours de cong\u00e9s pay\u00e9s, soit 2,5 jours par mois, en vertu de la loi.<\/p>\n<p style=\"text-align: justify;\">Certaines conventions collectives ou accords d\u2019entreprises, le contrat de travail ou un usage d\u2019entreprise peuvent pr\u00e9voir qu\u2019un nombre sup\u00e9rieur de jours de cong\u00e9s pay\u00e9s sera accord\u00e9 aux salari\u00e9s. Il est donc n\u00e9cessaire d\u2019\u00eatre au fait quant \u00e0 la convention collective applicable.<\/p>\n<p style=\"text-align: justify;\">En fin de contrat, tout jour de cong\u00e9 pay\u00e9 qui n\u2019aura pas \u00e9t\u00e9 pris par le salari\u00e9 lui ouvre droit \u00e0 une indemnit\u00e9 compensatrice de cong\u00e9s pay\u00e9s. Sauf si ce salari\u00e9 est licenci\u00e9 pour faute lourde.<\/p>\n<p style=\"text-align: justify;\">En r\u00e8gle g\u00e9n\u00e9rale, l\u2019indemnit\u00e9 correspond \u00e0 10% de la r\u00e9mun\u00e9ration de la p\u00e9riode de r\u00e9f\u00e9rence. Etant donn\u00e9 que la loi ouvre droit \u00e0 2,5 jours de cong\u00e9s pay\u00e9s par mois. Le salari\u00e9 a droit \u00e0 une indemnit\u00e9 de 10% d\u2019un mois de salaire \u00e0 chaque \u00ab\u00a0paquet\u00a0\u00bb de 2,5 jours qu\u2019il n\u2019a pas pris. Par exemple, si le salari\u00e9 n\u2019a pas pris 10 jours de cong\u00e9s pay\u00e9s (4 x 2,5 jours = 10 jours), la p\u00e9riode de r\u00e9f\u00e9rence est de quatre mois\u00a0: l\u2019indemnit\u00e9 \u00e9quivaut alors \u00e0 10% de 4 mois de salaire.<\/p>\n<h2 style=\"text-align: justify;\">L\u2019intervention de l\u2019employeur dans les cong\u00e9s du salari\u00e9<\/h2>\n<p class=\"row baseline--default\" style=\"text-align: justify;\">L\u2019employeur ne dispose que d\u2019un pouvoir limit\u00e9 sur la prise de cong\u00e9s pay\u00e9s par le salari\u00e9\u00a0:<\/p>\n<ul class=\"classic-list row\" style=\"text-align: justify;\">\n<li class=\"row baseline--default\">Il peut fixer la p\u00e9riode pendant laquelle des cong\u00e9s peuvent \u00eatre pos\u00e9s. Sachant que la dur\u00e9e l\u00e9gale minimum dure du 1er mai au 31 octobre.<\/li>\n<li class=\"row baseline--default\">L\u2019employeur ne peut pas refuser \u00e0 deux conjoints travaillant dans la m\u00eame entreprise de prendre des cong\u00e9s simultan\u00e9s.<\/li>\n<li class=\"row baseline--default\">En revanche, il peut interdire \u00e0 un salari\u00e9 de prendre plus de 24 jours de cong\u00e9s cons\u00e9cutifs. (sauf circonstances exceptionnelles de salari\u00e9s \u00e9trangers ou originaires des DROM). A l\u2019inverse, l\u2019employeur ne peut pas refuser un cong\u00e9 de moins de 12 jours cons\u00e9cutifs, sauf surcharge exceptionnelle de travail ou risque de perte de continuit\u00e9 d\u2019un service. Il existe une exception \u00e0 l\u2019exception\u00a0: m\u00eame en cas de forte activit\u00e9, un salari\u00e9 doit pouvoir prendre un cong\u00e9 pour raisons familiales (mariage ou naissance, notamment).<\/li>\n<li class=\"row baseline--default\">Entre 12 et 24 jours, l\u2019employeur peut demander au salari\u00e9 de fractionner son cong\u00e9 en 2 p\u00e9riodes.
