La preuve est d\u2019ailleurs plus facile \u00e0 rapporter et les tribunaux ont tendance \u00e0 sanctionner les employeurs lorsque, par exemple, le m\u00eame employeur \u00e9carte syst\u00e9matiquement des candidats au nom patronymique \u00e0 consonance \u00e9trang\u00e8re.<\/p>\n<p>Par ailleurs, il existe tr\u00e8s peu d\u2019exceptions au principe de non-discrimination. Le seul exemple \u00e9vident qui soit syst\u00e9matiquement accept\u00e9 est celui du cin\u00e9ma. Ainsi, un homme ne peut pas d\u00e9noncer une discrimination s\u2019il n\u2019est pas retenu pour un r\u00f4le de femme.<\/p>\n<p>C\u2019est pour cette raison qu\u2019il faut prendre un soin attentif lors de la r\u00e9daction d\u2019une\u00a0<a href=\"https:\/\/www.legalife.fr\/document\/description-de-poste\">description de poste<\/a>.\u00a0De sorte qu\u2019aucun crit\u00e8re\u00a0discriminant\u00a0ne soit ins\u00e9r\u00e9. (exemples\u00a0: plus de 30 ans, caucasien, de sexe masculin, c\u00e9libataire, sans enfants, etc).<\/p>\n<h2><span id=\"Que_prevoit_la_loi_en_matiere_de_discrimination\">Que pr\u00e9voit la loi en mati\u00e8re de discrimination ?<\/span><\/h2>\n<p>En mati\u00e8re d\u2019acc\u00e8s \u00e0 l\u2019emploi, la loi pr\u00e9voit une discrimination positive dans certains cas\u00a0:<\/p>\n<ul>\n<li>Les diff\u00e9rences de traitement fond\u00e9es sur l\u2019\u00e2ge ne constituent pas une discrimination lorsqu\u2019elles sont justifi\u00e9es par une politique de l\u2019emploi favorable aux jeunes ou aux seniors.<\/li>\n<li>Les diff\u00e9rences des traitements fond\u00e9es sur l\u2019inaptitude constat\u00e9e par le m\u00e9decin du travail ne constituent pas une discrimination lorsqu\u2019elles sont n\u00e9cessaires.<\/li>\n<li>Les mesures en faveur des personnes handicap\u00e9es ne constituent pas une discrimination.<\/li>\n<li>Le Code du travail pr\u00e9voit une liste des cas o\u00f9 le fait d\u2019\u00eatre un homme ou une femme est une condition d\u00e9terminante de l\u2019emploi.<\/li>\n<\/ul>\n<h2><span id=\"La_discrimination_sur_le_lieu_de_travail\">La discrimination sur le lieu de travail<\/span><\/h2>\n<p>M\u00eame une fois le <a href=\"https:\/\/www.legalife.fr\/modele\/contrat-de-travail-a-duree-indeterminee\">contrat de travail<\/a> sign\u00e9, les salari\u00e9s doivent \u00eatre trait\u00e9s de fa\u00e7on relativement \u00e9gale.
