Certaines conventions collectives viennent modifier le SMIC (\u00e0 la hausse ou \u00e0 la baisse). Donc tout employeur doit savoir quelle convention collective est applicable \u00e0 son entreprise.<\/p>\n<p>L\u00e9galement, en avril 2015, le montant est de 9,61\u20ac par heure de travail, soit 1\u00a0457,52\u20ac bruts par mois.<\/p>\n<h2><span id=\"Les_modalites_de_versement_du_salaire\">Les modalit\u00e9s de versement du salaire<\/span><\/h2>\n<h3><span id=\"Le_moyen_de_paiement\">Le moyen de paiement<\/span><\/h3>\n<p>Le salaire peut \u00eatre vers\u00e9 par virement bancaire, par ch\u00e8que ou par esp\u00e8ces.<\/p>\n<p>L\u2019employeur est dans l\u2019obligation de verser le salaire comme le salari\u00e9 le lui a demand\u00e9. Cependant, il est interdit de verser un salaire en esp\u00e8ces au-dessus de 1\u00a0500 euros.<\/p>\n<h3><span id=\"La_periodicite_du_salaire\">La p\u00e9riodicit\u00e9 du salaire<\/span><\/h3>\n<p>Pour les salaires mensualis\u00e9s, le d\u00e9lai de versement entre deux salaires ne peut pas exc\u00e9der 1 mois. Le salaire est g\u00e9n\u00e9ralement vers\u00e9 en fin de mois ou au d\u00e9but du mois qui suit.<\/p>\n<p>Pour les salaires non-mensualis\u00e9s (travail saisonnier, temporaire), le d\u00e9lai entre deux salaires ne peut pas exc\u00e9der 16 jours. Et le salaire doit \u00eatre vers\u00e9 2 fois par mois.<\/p>\n<h2><span id=\"Les_heures_supplementaires\">Les heures suppl\u00e9mentaires<\/span><\/h2>\n<p>Tout travailleur (hors cadres dirigeants) qui travaille une heure au-del\u00e0 des 35 heures l\u00e9gales doit \u00eatre pay\u00e9 en heure suppl\u00e9mentaire. Sauf si un accord d\u2019entreprises ou une convention collective pr\u00e9voit un m\u00e9canisme de repos compensatoire.<\/p>\n<p>Sauf accord d\u2019entreprises ou convention collective contraire, les heures suppl\u00e9mentaires entre la 36\u00e8me et la 43\u00e8me heure sont major\u00e9es de 25%. A partir de la 44\u00e8me heure, le salari\u00e9 est pay\u00e9 150% du SMIC.<\/p>\n<p>Les accords ou conventions applicables ne peuvent pas pr\u00e9voir une majoration de moins de 10%.<\/p>\n<h2><span id=\"Les_primes_du_salarie\">Les primes du salari\u00e9<\/span><\/h2>\n<h3><span id=\"Les_primes_et_gratifications_annuelles\">Les primes et gratifications annuelles<\/span><\/h3>\n<p>Ce sont notamment les primes de fin d\u2019ann\u00e9e, de 13\u00e8me mois, les primes de vacances, de bilan ou encore de participation.<\/p>\n<p>Ces primes sont g\u00e9n\u00e9ralement pr\u00e9vues par la convention collective ou l\u2019accord collectif applicable. Un usage d\u2019entreprise peut \u00e9galement \u00eatre \u00e0 l\u2019origine du versement de gratifications annuelles pour tous les salari\u00e9s.<\/p>\n<p>Le montant et ses modalit\u00e9s de versement sont fix\u00e9s soit par l\u2019employeur, soit par l\u2019accord imposant le versement de la prime.<\/p>\n<p>Il est possible d\u2019exiger du salari\u00e9 une certaine anciennet\u00e9 pour percevoir ce genre de prime, ou exiger qu\u2019il soit en poste au jour du versement.<\/p>\n<h3><span id=\"Les_primes_relatives_aux_qualites_personnelles\">Les primes relatives aux qualit\u00e9s personnelles<\/span><\/h3>\n<p>Cela concerne les primes de rendements, d\u2019assiduit\u00e9, de ponctualit\u00e9 ou encore d\u2019anciennet\u00e9. Ces primes ne sont pas habituelles, et d\u00e9pendent d\u2019\u00e9v\u00e9nements propres au salari\u00e9 comme l\u2019accomplissement d\u2019objectifs (individuels ou collectifs) ou la pr\u00e9sence dans l\u2019entreprise.<\/p>\n<p>Comme les primes annuelles, certaines sont mises en place par des accords collectifs et leur montant et p\u00e9riodicit\u00e9 sont d\u00e9cid\u00e9es par ces accords.
