Il est soumis \u00e0 l\u2019article 1128 du Code civil, relatif aux conditions de validit\u00e9 des contrats. Ainsi, pour \u00eatre valide, les parties d\u2019un contrat de travail \u00e0 dur\u00e9e ind\u00e9termin\u00e9e doivent\u00a0:<\/p>\n<ul>\n<li>Avoir exprim\u00e9 leur consentement valablement\u00a0; et<\/li>\n<li>Avoir la capacit\u00e9 juridique pour contracter.<\/li>\n<\/ul>\n<p>En outre, le contrat en soi doit\u00a0:<\/p>\n<ul>\n<li>Avoir un contenu\u00a0licite et certain.<\/li>\n<\/ul>\n<p>Ceci signifie qu\u2019en mati\u00e8re de consentement, les parties doivent avoir contract\u00e9 sans que leur consentement ait \u00e9t\u00e9 vici\u00e9 par une erreur, par une man\u0153uvre dolosive ou par violence.<\/p>\n<p>Si une de ces conditions essentielles de validit\u00e9 du contrat est viol\u00e9e, le conseil des prud\u2019hommes annulera le contrat, sans pour autant annuler les effets produits pendant la signature du contrat et son annulation.<\/p>\n<h2><span id=\"La_forme_du_contrat_de_travail_a_duree_indeterminee\">La forme du contrat de travail \u00e0 dur\u00e9e ind\u00e9termin\u00e9e<\/span><\/h2>\n<p>Pour ce qui est de la forme du contrat, il est conseill\u00e9 de pr\u00e9voir un \u00e9crit, afin de garder une preuve litt\u00e9rale du contrat et de son contenu, notamment en mati\u00e8re fiscale. Dans ce cas, le contrat doit \u00eatre fait, dat\u00e9 et sign\u00e9 en deux exemplaires et imp\u00e9rativement r\u00e9dig\u00e9 en fran\u00e7ais selon l\u2019<a href=\"http:\/\/www.legifrance.gouv.fr\/affichCodeArticle.do?cidTexte=LEGITEXT000006072050&amp;idArticle=LEGIARTI000006900842\" target=\"_blank\" rel=\"noopener noreferrer\">article L.1221-3 du Code du travail<\/a>.<\/p>\n<p>M\u00eame si c\u2019est un CDI, le contrat d\u2019un salari\u00e9 \u00e0 temps partiel doit en revanche absolument \u00eatre \u00e9crit.<\/p>\n<p>Si le salari\u00e9 est \u00e9tranger et qu\u2019il en fait la demande, une traduction doit \u00eatre r\u00e9dig\u00e9e et transmise au salari\u00e9. Cette version traduite fait foi en justice, et en cas de litige portant sur le contrat, seule la version traduite peut \u00eatre invoqu\u00e9e \u00e0 l\u2019encontre du salari\u00e9.<\/p>\n<p>Cependant, malgr\u00e9 le fait qu&#8217;un contrat de travail soit r\u00e9dig\u00e9 dans la majorit\u00e9 des cas, rien n\u2019emp\u00eache qu\u2019il soit purement verbal. Un simple \u00e9change des consentements suffit.<br \/>\nIl suffit simplement de bien se renseigner car une convention collective peut imposer la r\u00e9daction de tout ou partie du contrat de travail.<\/p>\n<p>Dans ce cas, selon la directive europ\u00e9enne n\u00b091\/533 du 14 septembre 1991, l\u2019employeur est tenu d\u2019envoyer dans les deux mois qui suivent le d\u00e9but du contrat de travail, un \u00e9crit afin d\u2019informer le salari\u00e9 des conditions essentielles de son contrat, \u00e0 savoir\u00a0:<\/p>\n<ul>\n<li>L\u2019identit\u00e9 des parties contractantes\u00a0;<\/li>\n<li>Le lieu de travail ;<\/li>\n<li>La description sommaire des fonctions du salari\u00e9\u00a0;<\/li>\n<li>Ainsi que la date de d\u00e9but du contrat, ainsi que la dur\u00e9e de cong\u00e9s pay\u00e9s\u00a0;<\/li>\n<li>Le d\u00e9lai de pr\u00e9avis en cas de cessation du contrat de travail,\u00a0;<\/li>\n<li>La composition du salaire\u00a0;<\/li>\n<li>Le temps de travail journalier ou hebdomadaire ; et<\/li>\n<li>La mention des conventions et accords collectifs applicables, le cas \u00e9ch\u00e9ant.<\/li>\n<\/ul>\n<h2><span id=\"La_preuve_du_contrat_de_travail_a_duree_indeterminee\">La preuve du contrat de travail \u00e0 dur\u00e9e ind\u00e9termin\u00e9e<\/span><\/h2>\n<p>En mati\u00e8re de preuve, le contrat \u00e0 dur\u00e9e ind\u00e9termin\u00e9e suit le r\u00e9gime de la preuve des obligations \u00e9nonc\u00e9 \u00e0 l\u2019<a href=\"http:\/\/www.legifrance.gouv.fr\/affichCodeArticle.do?idArticle=LEGIARTI000006437767&amp;cidTexte=LEGITEXT000006070721\" target=\"_blank\" rel=\"noopener noreferrer\">article 1315 du Code civil<\/a>, \u00e0 savoir\u00a0: \u00ab\u00a0Celui qui r\u00e9clame l\u2019ex\u00e9cution d\u2019une obligation doit la prouver. R\u00e9ciproquement, celui qui se pr\u00e9tend lib\u00e9r\u00e9 d\u2019une obligation doit justifier le paiement ou le fait qui a produit l\u2019extinction de son obligation\u00a0\u00bb.<\/p>\n<p>Ainsi, la preuve de l\u2019existence d\u2019un contrat de travail incombe \u00e0 celui qui se pr\u00e9vaut des obligations qui y sont contenues.<\/p>\n<p>La sp\u00e9cificit\u00e9 du contrat de travail tient au fait que tous les proc\u00e9d\u00e9s de preuve sont admis afin d\u2019\u00e9tablir l\u2019existence d\u2019un contrat de travail.
