R\u00e9dig\u00e9e par le bailleur (propri\u00e9taire ou administrateur de biens), elle est destin\u00e9e au locataire. Il pourra s&#8217;en servir comme justificatif de paiement, mais aussi comme justificatif de domicile. Certaines administrations exigent une quittance avant d&#8217;ouvrir certains droits (par exemple la CAF pour compl\u00e9ter un dossier d&#8217;aides au logement). D\u00e9livrer ce document n&#8217;est d&#8217;ailleurs pas obligatoire&#8230; jusqu&#8217;\u00e0 ce que le locataire le r\u00e9clame (<a href=\"https:\/\/www.legifrance.gouv.fr\/affichTexte.do?cidTexte=JORFTEXT000000509310\" target=\"_blank\">loi du 6 juillet 1989<\/a>).<\/p>\n<h2 style=\"text-align: justify;\"><span id=\"Une_emission_a_la_demande_de_la_quittance_de_loyer\">Une \u00e9mission \u00e0 la demande de la quittance de loyer<\/span><\/h2>\n<p style=\"text-align: justify;\">Bien qu&#8217;elle soit un \u00e9l\u00e9ment essentiel des <a title=\"Les rapports bailleur-locataire\" href=\" https:\/\/www.legalife.fr\/guides-juridiques\/les-rapports-bailleur--locataire\"> rapports entre le bailleur et son locataire<\/a>, la d\u00e9livrance d&#8217;une quittance n&#8217;est pas automatique. Mais d\u00e8s lors qu&#8217;un locataire en effectue la demande, le bailleur a l&#8217;obligation de lui remettre ce document. A condition toutefois que celui-ci soit \u00e0 jour dans le paiement de ses loyers mais aussi de ses charges. Et ce, m\u00eame si un r\u00e8glement par virement ou par ch\u00e8que est consid\u00e9r\u00e9 comme preuve de paiement (le relev\u00e9 bancaire l&#8217;attestant clairement), au m\u00eame titre qu&#8217;une quittance.<\/p>\n<p style=\"text-align: justify;\">Toute inex\u00e9cution volontaire est d&#8217;ailleurs consid\u00e9r\u00e9e comme une faute. Elle est\u00a0ainsi punissable de dommages et int\u00e9r\u00eats. Cette indemnisation vise \u00e0 compenser un \u00e9ventuel pr\u00e9judice subi par le locataire. Un risque qu&#8217;il est d&#8217;autant plus inutile de prendre qu&#8217;une quittance de loyer s&#8217;av\u00e8re particuli\u00e8rement simple \u00e0 r\u00e9diger, y compris pour les n\u00e9ophytes. \u00c0 noter qu&#8217;un locataire peut exiger ses <a href=\"https:\/\/www.legalife.fr\/modele\/quittance-de-loyer\/creation\/\">quittances de loyer<\/a> \u00e9galement apr\u00e8s avoir r\u00e9sili\u00e9 son bail.<\/p>\n<p style=\"text-align: justify;\">La quittance est remise gratuitement au locataire, voir \u00e0 ce sujet notre article : la\u00a0<a title=\"La quittance de loyer doit \u00eatre remise gratuitement\" href=\"https:\/\/www.legalife.fr\/blog\/la-quittance-de-loyer-doit-etre-remise-gratuitement\/\">quittance de loyer doit \u00eatre remise gratuitement<\/a>.<\/p>\n<h2 style=\"text-align: justify;\"><span id=\"Les_mentions_obligatoires_de_la_quittance_de_loyer\">Les mentions obligatoires de la quittance de loyer<\/span><\/h2>\n<p style=\"text-align: justify;\">La <a href=\"https:\/\/www.legalife.fr\/modele\/quittance-de-loyer\/creation\/\">formulation d&#8217;une quittance de loyer<\/a> n&#8217;implique pas de connaissances juridiques approfondies, puisque seules quelques mentions doivent imp\u00e9rativement appara\u00eetre :<\/p>\n<ul style=\"text-align: justify;\">\n<li>nom et pr\u00e9nom, ainsi qu&#8217;adresse compl\u00e8te du bailleur ;<\/li>\n<li>nom et pr\u00e9nom, ainsi qu&#8217;adresse compl\u00e8te du locataire ;<\/li>\n<li>p\u00e9riode correspondant au r\u00e8glement effectu\u00e9 ;<\/li>\n<li>montant total des sommes vers\u00e9es et composition (loyer, charges&#8230;) en lettres et en chiffres ; et<\/li>\n<li>d\u00e9tails des charges (provisions sur charges, d\u00e9penses forfaitaires, r\u00e9gularisation&#8230;).<\/li>\n<\/ul>\n<p style=\"text-align: justify;\">Si certains loyers pr\u00e9c\u00e9dents n&#8217;ont pas \u00e9t\u00e9 r\u00e9gl\u00e9s dans leur int\u00e9gralit\u00e9 \u00e0 leur \u00e9ch\u00e9ance, le bailleur peut \u00e9galement pr\u00e9ciser le montant des sommes restantes \u00e0 payer.<\/p>\n<p style=\"text-align: justify;\">Enfin, si le paiement n&#8217;est que partiel, le propri\u00e9taire ne devra pas d\u00e9livrer une quittance mais un <a href=\"https:\/\/www.legalife.fr\/modele\/recu-de-paiement-partiel-de-loyer\/\">re\u00e7u de paiement partiel de loyer<\/a>.<\/p>\n<p style=\"text-align: justify;\">Des bordereaux pr\u00e9\u00e9tablis (il suffit juste de compl\u00e9ter les mentions) sont \u00e9galement commercialis\u00e9s, afin de simplifier au maximum la r\u00e9daction de cette quittance de loyer.<\/p>\n<p style=\"text-align: justify;\">Pour en savoir plus sur la relation bailleur \/ locataire, vous pouvez consulter notre guide juridique : les\u00a0<a title=\"rapports bailleurs - locataires\" href=\"https:\/\/www.legalife.fr\/guides-juridiques\/les-rapports-bailleur--locataire\">rapports bailleurs &#8211;
