Elle lui permet donc d\u2019informer le salari\u00e9 de sa d\u00e9sapprobation quant \u00e0 son comportement. Tout en ayant plus de port\u00e9e qu\u2019une simple observation ou qu\u2019un avertissement oral.<\/p>\n<p style=\"text-align: justify;\">Les faits concern\u00e9s, s\u2019ils ne permettent pas de justifier un licenciement, doivent cependant \u00eatre suffisamment graves. Et ce, en eux-m\u00eame ou du fait de leur r\u00e9p\u00e9tition, pour justifier une sanction du salari\u00e9. Il peut s\u2019agir par exemple de retards r\u00e9p\u00e9t\u00e9s, d\u2019une violation du r\u00e8glement int\u00e9rieur, d\u2019un refus d\u2019ob\u00e9ir aux ordres de l\u2019employeur, mais aussi d\u2019erreurs ou de n\u00e9gligences commises par le salari\u00e9.<\/p>\n<p style=\"text-align: justify;\">Le bl\u00e2me, s\u2019il s\u2019agit de la sanction disciplinaire la plus faible dans l\u2019\u00e9chelle des sanctions, n\u2019est pas inutile puisqu\u2019il s\u2019agit d\u2019une mise en garde du salari\u00e9. Cela permettant de l\u2019inciter \u00e0 changer de comportement. Et il pourra par la suite \u00eatre invoqu\u00e9 par l\u2019employeur au soutien d\u2019un licenciement. Aucun entretien pr\u00e9alable n\u2019est notamment impos\u00e9 contrairement au licenciement. Toutefois, le r\u00e8glement int\u00e9rieur, obligatoire dans toutes les entreprises employant habituellement 20 salari\u00e9s ou plus, peut pr\u00e9voir une proc\u00e9dure sp\u00e9cifique \u00e0 respecter pour adresser un bl\u00e2me aux salari\u00e9s. Elle devra dans ce cas \u00eatre suivie par l\u2019employeur.<\/p>\n<p style=\"text-align: justify;\">Le bl\u00e2me constitue cependant une sanction. A ce titre et en application de l\u2019article L1331-1 du Code du travail, il doit donc \u00eatre adress\u00e9 par \u00e9crit.<\/p>\n<p style=\"text-align: justify;\">Concr\u00e8tement, l\u2019employeur doit <a href=\"https:\/\/www.legalife.fr\/modele\/lettre-de-blame-a-un-salarie\">notifier par \u00e9crit le bl\u00e2me au salari\u00e9 par une lettre<\/a> dans les deux mois suivant la commission, ou la connaissance par l\u2019employeur, des faits fautifs.<\/p>\n<p style=\"text-align: justify;\">Si ce bl\u00e2me peut \u00eatre notifi\u00e9e par lettre simple, puisque la loi n\u2019impose aucune exigence de forme particuli\u00e8re. Il est toutefois recommand\u00e9 de l\u2019adresser au salari\u00e9 par lettre recommand\u00e9e avec accus\u00e9 de r\u00e9ception ou de la remettre en mains propres au salari\u00e9 contre d\u00e9charge. Cela permettra \u00e0 l\u2019employeur de se m\u00e9nager la preuve de la r\u00e9ception du bl\u00e2me par le salari\u00e9.<\/p>\n<p style=\"text-align: justify;\">De plus, il est recommand\u00e9 de justifier autant que possible cette sanction dans le corps de la lettre. Toute sanction doit en effet \u00eatre motiv\u00e9e par l\u2019employeur. En outre, plus vous serez pr\u00e9cis, plus faible sera le risque de contestation de la part du salari\u00e9. N\u2019h\u00e9sitez donc pas \u00e0 d\u00e9tailler pr\u00e9cis\u00e9ment les faits reproch\u00e9s.
