Il est cependant recommand\u00e9 de le pr\u00e9voir afin de renforcer l\u2019engagement des parties. En effet, si les parties s\u2019engagent par la <a href=\"https:\/\/www.legalife.fr\/guides-juridiques\/comment-signer-un-compromis-de-vente-\">signature du compromis de vente<\/a> \u00e0 signer ult\u00e9rieurement l\u2019<a href=\"https:\/\/www.legalife.fr\/guides-juridiques\/signer-un-acte-de-vente-immobilier-chez-un-notaire\">acte de vente<\/a> pour conclure la vente d\u00e9finitive, la demande d&#8217;acompte constitue une garantie suppl\u00e9mentaire pour le vendeur de l\u2019engagement de l\u2019acqu\u00e9reur et de sa solvabilit\u00e9. Il sera le plus souvent en pratique fix\u00e9 \u00e0 hauteur de 5 \u00e0 10 % du prix de vente (hors <a href=\"https:\/\/www.legalife.fr\/guides-juridiques\/frais-de-notaire-vente-immeuble\/\" target=\"_blank\" rel=\"noopener noreferrer\">frais de notaire<\/a>).<\/p>\n<p style=\"text-align: justify;\"><img loading=\"lazy\" class=\"alignnone wp-image-4358 size-full\" src=\"https:\/\/d1mxkq1wocxjoy.cloudfront.net\/guides-uploads\/2015\/08\/22230236\/acompte-notaire-compromis.png\" alt=\"acompte notaire compromis\" width=\"720\" height=\"380\" srcset=\"https:\/\/d1mxkq1wocxjoy.cloudfront.net\/guides-uploads\/2015\/08\/22230236\/acompte-notaire-compromis.png 720w, https:\/\/d1mxkq1wocxjoy.cloudfront.net\/guides-uploads\/2015\/08\/22230236\/acompte-notaire-compromis-300x158.png 300w\" sizes=\"(max-width: 720px) 100vw, 720px\" \/><\/p>\n<h2 style=\"text-align: justify;\"><span id=\"L8217acompte_une_somme_consignee_par_le_notaire_jusqua_la_vente\">L&#8217;acompte : une somme consign\u00e9e par le notaire jusqu\u2019\u00e0 la vente<\/span><\/h2>\n<p style=\"text-align: justify;\">Cette somme sera pay\u00e9e en principe apr\u00e8s la <a href=\"https:\/\/www.legalife.fr\/guides-juridiques\/comment-signer-un-compromis-de-vente-\">signature du compromis de vente<\/a>, \u00e0 l\u2019expiration du d\u00e9lai de r\u00e9tractation de 10 jours conf\u00e9r\u00e9 \u00e0 l\u2019acqu\u00e9reur.<\/p>\n<p style=\"text-align: justify;\">Si le compromis de vente est sign\u00e9 par acte authentique, devant un <a href=\"https:\/\/www.legalife.fr\/guides-juridiques\/notaire-droit-immobilier\/\" target=\"_blank\" rel=\"noopener noreferrer\">notaire sp\u00e9cialiste en droit de l\u2019immobilier<\/a>, l\u2019acompte sera vers\u00e9 au notaire (et non au vendeur) par virement bancaire, afin que celui-ci le bloque sur un compte bancaire jusqu\u2019\u00e0 la <a href=\"https:\/\/www.legalife.fr\/guides-juridiques\/signer-un-acte-de-vente-immobilier-chez-un-notaire\">signature de l\u2019acte d\u00e9finitif de vente<\/a>.<\/p>\n<p style=\"text-align: justify;\">Si le compromis de vente est r\u00e9alis\u00e9 par acte sous seing priv\u00e9 entre les parties, il est \u00e9galement recommand\u00e9 de choisir un <a href=\"https:\/\/www.legalife.fr\/guides-juridiques\/notaire-droit-immobilier\/\" target=\"_blank\" rel=\"noopener noreferrer\">notaire, sp\u00e9cialiste du droit immobilier<\/a>, afin de lui confier la consignation de cette somme plut\u00f4t que de la verser directement au vendeur. Cela permettra en effet \u00e0 l\u2019acqu\u00e9reur d\u2019\u00e9viter des difficult\u00e9s si la vente ne peut finalement pas se r\u00e9aliser et qu\u2019il doit r\u00e9cup\u00e9rer la somme vers\u00e9e. Cette solution constitue une garantie pour les deux parties (le vendeur et l&#8217;acqu\u00e9reur). Le vendeur qui s\u2019assure du s\u00e9rieux de l\u2019acqu\u00e9reur, et l\u2019acqu\u00e9reur qui sait que son acompte sera conserv\u00e9 par le notaire jusqu\u2019\u00e0 la <a href=\"https:\/\/www.legalife.fr\/guides-juridiques\/signer-acte-de-vente-immobiliere-notaire\/\">conclusion d\u00e9finitive de la vente immobili\u00e8re<\/a>. Il devra alors notifier cette d\u00e9cision au vendeur par lettre recommand\u00e9e avec demande d\u2019avis de r\u00e9ception. Il n\u2019aura aucun motif \u00e0 faire valoir pour pouvoir se r\u00e9tracter, et aucun paiement d\u2019indemnit\u00e9 ne pourra lui \u00eatre demand\u00e9. En principe, l\u2019acompte n\u2019aura pas \u00e9t\u00e9 vers\u00e9 avant l\u2019expiration de ce d\u00e9lai. Mais si cela est le cas, il devra lui \u00eatre restitu\u00e9.<\/p>\n<p style=\"text-align: justify;\">La situation est diff\u00e9rente si l\u2019acqu\u00e9reur renonce apr\u00e8s l\u2019expiration de son <a href=\"https:\/\/www.legalife.fr\/guides-juridiques\/delai-de-retractation-du-compromis-de-vente\/\">d\u00e9lai de r\u00e9tractation<\/a>. Obtention d\u2019un cr\u00e9dit par l\u2019acqu\u00e9reur, absence d\u2019exercice d\u2019un <a href=\"https:\/\/www.legalife.fr\/guides-juridiques\/le-droit-de-preemption-urbain\/\">droit de pr\u00e9emption par la commune<\/a> ou par le locataire. En cas de vente d\u2019un logement lou\u00e9 par exemple, autorisation de la mairie pour effectuer certains travaux \u2026 Lorsqu\u2019il existe de telles conditions mentionn\u00e9es dans le compromis de vente, leur non r\u00e9alisation entra\u00eene automatiquement la <a href=\"https:\/\/www.legalife.fr\/guides-juridiques\/lexique-juridique\/caducite\/\" target=\"_blank\" rel=\"noopener noreferrer\">caducit\u00e9<\/a> du <a href=\"https:\/\/www.legalife.fr\/modele\/compromis-de-vente\/\">compromis de vente<\/a>. Les parties sont donc lib\u00e9r\u00e9es de leur engagement. Aucune indemnit\u00e9 n\u2019est due dans ce cas par l\u2019acqu\u00e9reur.
