L&#8217;employeur <a title=\"L'acceptation de candidature\" href=\"https:\/\/www.legalife.fr\/document\/acceptation-de-candidature\">accepte la candidature<\/a>, sans pour autant que le contrat de travail puisse \u00eatre sign\u00e9 imm\u00e9diatement.<\/p>\n<p style=\"text-align: justify;\">Dans ces circonstances, la promesse d&#8217;embauche joue le r\u00f4le d&#8217;une assurance r\u00e9ciproque, avant la signature du contrat de travail. Le d\u00e9lai suppl\u00e9mentaire pour la signature du contrat de travail peut \u00eatre du fait du salari\u00e9 comme de celui de l\u2019employeur. Par exemple, un salari\u00e9 quittant son entreprise ne peut signer un nouveau contrat de travail avant la fin de son pr\u00e9avis l\u00e9gal. De m\u00eame, un employeur cherchant \u00e0 remplacer une personne encore en poste ne peut signer un contrat de travail avant le d\u00e9part de la personne concern\u00e9e.<\/p>\n<p style=\"text-align: justify;\"><a title=\"S'engager avant la signature du contrat de travail\" href=\"https:\/\/www.legalife.fr\/guides-juridiques\/sengager-avant-la-signature-du-contrat-de-travail\">M\u00eame avant la signature du contrat de travail d\u00e9finitif<\/a>, cet engagement r\u00e9ciproque devient opposable au futur salari\u00e9 comme \u00e0 l&#8217;employeur d\u00e8s sa signature. Le non-respect de ses termes ouvre ainsi droit \u00e0 une r\u00e9paration en justice. En effet, la promesse \u00e9quivaut \u00e0 un contrat de travail, et sa rupture \u00e0 un licenciement sans cause r\u00e9elle et s\u00e9rieuse.<\/p>\n<p style=\"text-align: justify;\">A noter que la promesse d&#8217;embauche peut s&#8217;accompagner d&#8217;une condition, du c\u00f4t\u00e9 de l&#8217;employeur comme du salari\u00e9. C&#8217;est notamment le cas lorsque l&#8217;embauche est conditionn\u00e9e \u00e0 l&#8217;ouverture d&#8217;un nouvel \u00e9tablissement par l&#8217;entreprise, ou \u00e0 l&#8217;obtention d&#8217;un dipl\u00f4me par le salari\u00e9. Le non-accomplissement de cette condition rendra caduque la promesse d&#8217;embauche.<\/p>\n<h2 style=\"text-align: justify;\">Comment r\u00e9diger une promesse d&#8217;embauche ?<\/h2>\n<p style=\"text-align: justify;\">Le Code du travail n&#8217;apporte aucune pr\u00e9cision particuli\u00e8re concernant la r\u00e9daction d&#8217;une <a title=\"La promesse d'embauche\" href=\"https:\/\/www.legalife.fr\/document\/promesse-dembauche\">promesse d&#8217;embauche<\/a>, qui peut \u00eatre \u00e9crite comme orale. Toutefois, en cas de litige, mieux vaut disposer d&#8217;une promesse d&#8217;embauche \u00e9crite, en bonne et due forme.<\/p>\n<p style=\"text-align: justify;\">Cette promesse ne peut \u00eatre sign\u00e9e que par le repr\u00e9sentant l\u00e9gal de l&#8217;entreprise. Elle doit comprendre trois mentions essentielles : la fonction du futur salari\u00e9, sa r\u00e9mun\u00e9ration et ses horaires de travail. Ces trois mentions pour la validit\u00e9 de la promesse d&#8217;embauche feront foi lors de la signature du contrat de travail. Ainsi, tout changement de ces mentions vous sera opposable par le salari\u00e9, au titre d&#8217;une rupture contractuelle de la promesse.<\/p>\n<p style=\"text-align: justify;\">Enfin, il est recommand\u00e9 aux deux parties de signer la promesse d&#8217;embauche et d&#8217;en conserver un exemplaire. De fa\u00e7on \u00e0 confirmer l&#8217;accord sur l&#8217;intitul\u00e9 du poste, la r\u00e9mun\u00e9ration et les horaires.<\/p>\n<p style=\"text-align: justify;\">Vous disposez maintenant de tous les \u00e9l\u00e9ments n\u00e9cessaires \u00e0 la compr\u00e9hension et \u00e0 la r\u00e9daction d&#8217;une promesse d&#8217;embauche.
