Si les mod\u00e8les ne sont pas obligatoires, leur contenu est consid\u00e9r\u00e9 comme essentiel. On fait le point sur l\u2019apport de ce d\u00e9cret.<\/p>\n<div id=\"toc_container\" class=\"no_bullets\"><p class=\"toc_title\">Table des mati&egrave;res<\/p><ul class=\"toc_list\"><li><a href=\"#Le_contenu_du_decret_du_29_mai_2015\"><span class=\"toc_number toc_depth_1\">1<\/span> Le contenu du d\u00e9cret du 29 mai 2015<\/a><\/li><li><a href=\"#Les_reactions_face_au_decret\"><span class=\"toc_number toc_depth_1\">2<\/span> Les r\u00e9actions face au d\u00e9cret<\/a><\/li><li><a href=\"#Les_suites_du_decret\"><span class=\"toc_number toc_depth_1\">3<\/span> Les suites du d\u00e9cret<\/a><\/li><\/ul><\/div>\n<h2 style=\"text-align: justify;\"><span id=\"Le_contenu_du_decret_du_29_mai_2015\">Le contenu du d\u00e9cret du 29 mai 2015<\/span><\/h2>\n<p>Auparavant, les parties \u00e9taient li\u00e9es par ce qu\u2019elles ins\u00e9raient dans leur contrat de bail, en plus de\u00a0certaines clauses obligatoires : composition du bien immobilier, montant du loyer, montant des charges, adresse pr\u00e9cise du bien, et date d\u2019\u00e9ch\u00e9ance du loyer.<\/p>\n<p>Chaque bail avait donc sa sp\u00e9cificit\u00e9, libre aux parties de pr\u00e9ciser ou non les contours de leur relation. C\u2019\u00e9tait notamment le cas pour les p\u00e9nalit\u00e9s en cas de retard du loyer : les juges pr\u00e9voyaient simplement qu\u2019elles ne devaient pas \u00eatre d\u00e9raisonnables, ce qui n\u2019\u00e9tait pas tr\u00e8s clair.<\/p>\n<p>Avec ce d\u00e9cret, le nombre de mentions devenues obligatoires est d\u2019une pr\u00e9cision sans pr\u00e9c\u00e9dent :<\/p>\n<ul>\n<li>Le montant et la date du dernier loyer ;<\/li>\n<li>Le montant des frais en cas d\u2019appel \u00e0 une agence immobili\u00e8re, d\u00e9sormais plafonn\u00e9s. Cette pr\u00e9cision s\u2019accompagne d\u2019un rappel sur les m\u00e9thodes pour calculer le montant maximal des honoraires d\u2019agences ;<\/li>\n<li>Le d\u00e9tail des modalit\u00e9s de r\u00e9cup\u00e9ration des charges ;<\/li>\n<li>La p\u00e9riode de construction de l\u2019immeuble ;<\/li>\n<li>Les modalit\u00e9s de baisse ou d\u2019augmentation du loyer ;<\/li>\n<li>La pr\u00e9sence ou l\u2019absence de travaux r\u00e9cents ;<\/li>\n<li>Une p\u00e9nalit\u00e9 de 10% maximum par mois de retard de loyer ;<\/li>\n<li>Les diagnostics techniques impos\u00e9s, etc.<\/li>\n<\/ul>\n<p>Par ailleurs, la loi ALUR, qui pr\u00e9voyait qu\u2019un d\u00e9cret pr\u00e9senterait les mod\u00e8les types de contrat de bail, pr\u00e9voit \u00e9galement un encadrement des loyers. M\u00eame si aucun texte ne le pr\u00e9voit encore, les mod\u00e8les types ins\u00e8rent les loyers de r\u00e9f\u00e9rence qui permettront de v\u00e9rifier que le loyer correspond bien aux normes \u00e0 venir en mati\u00e8re de plafonnement.<\/p>\n<p>Les parties ne seront libres que d\u2019ajouter des clauses suppl\u00e9mentaires si elles sont conformes \u00e0 la l\u00e9gislation en vigueur, mais les d\u00e9crets semblent avoir cherch\u00e9 \u00e0 envisager un maximum de situations.<\/p>\n<a class=\"mks_button mks_button_large squared\" href=\"https:\/\/www.legalife.fr\/document\/bail-dhabitation-non-meublee\" target=\"_self\" style=\"color: #FFFFFF; background-color: #f86b50\" ><i class=\"fa fa-angle-right\"><\/i>Cr\u00e9er un contrat de bail d'habitation non meubl\u00e9e<\/a>\n<p>&nbsp;<\/p>\n<h2 style=\"text-align: justify;\"><span id=\"Les_reactions_face_au_decret\">Les r\u00e9actions face au d\u00e9cret<\/span><\/h2>\n<p>Deux camps se sont dress\u00e9s suite \u00e0 la parution du d\u00e9cret : d\u2019une part, les associations de locataires ou de consommateurs ont appr\u00e9ci\u00e9 le fait que l\u2019abus devenait compliqu\u00e9 avec les mod\u00e8les types. Par ailleurs, un arr\u00eat\u00e9 minist\u00e9riel du 29 mai 2015 (m\u00eame date) a constitu\u00e9 une notice des droits des parties au bail qui devra obligatoirement \u00eatre annex\u00e9e au bail. Ainsi, la conjonction des deux documents devra permettre au locataire de conna\u00eetre ses droits imm\u00e9diatement. En revanche, elles ont d\u00e9plor\u00e9 la complexification des transactions.<\/p>\n<p>De m\u00eame, les syndicats d\u2019agences immobili\u00e8res consid\u00e8rent qu\u2019un bail aussi d\u00e9taill\u00e9 risque de compliquer les relations entre bailleur et locataire. Quitte \u00e0 \u00eatre aussi d\u00e9taill\u00e9, les agences auraient pr\u00e9f\u00e9r\u00e9 que la notice d\u2019information soit int\u00e9gr\u00e9e au bail pour ne faire qu\u2019un seul document.<\/p>\n<p>Enfin, certains propri\u00e9taires se sont offusqu\u00e9s de la difficult\u00e9 que pr\u00e9sentaient certaines mentions devenues obligatoires : selon eux, ce mod\u00e8le de bail risque d\u2019\u00eatre r\u00e9serv\u00e9 aux professionnels (agences immobili\u00e8res) car il ne serait pas suffisamment souple et accessible pour le propri\u00e9taire non averti.<\/p>\n<h2 style=\"text-align: justify;\"><span id=\"Les_suites_du_decret\">Les suites du d\u00e9cret<\/span><\/h2>\n<p>La loi ALUR de 2014 pr\u00e9voyait que de nombreux d\u00e9crets viendraient pr\u00e9ciser les mesures d\u2019application de la loi.<\/p>\n<p>Si les frais d\u2019agences immobili\u00e8res ont donc \u00e9t\u00e9 effectivement plafonn\u00e9s (depuis le 15 septembre 2014), le d\u00e9cret du 29 mai 2015 marque la deuxi\u00e8me \u00e9tape de la mise en \u0153uvre par le gouvernement de la loi de C\u00e9cile Duflot.
