{"id":2052,"date":"2014-12-24T12:34:37","date_gmt":"2014-12-24T11:34:37","guid":{"rendered":"https:\/\/www.legalife.fr\/blog\/?p=2052"},"modified":"2016-04-19T10:49:50","modified_gmt":"2016-04-19T09:49:50","slug":"revision-du-loyer-des-baux-dhabitation","status":"publish","type":"post","link":"https:\/\/www.legalife.fr\/guides-juridiques\/revision-du-loyer-des-baux-dhabitation\/","title":{"rendered":"R\u00e9vision du loyer des baux d\u2019habitation"},"content":{"rendered":"<p>En tant que bailleur ou locataire d\u2019un bien immobilier \u00e0 usage d\u2019habitation (loi du 6 juillet 1989), vous avez la possibilit\u00e9, si vous l\u2019avez pr\u00e9vue dans le contrat de bail, de r\u00e9viser le bail en respectant quelques conditions essentielles.<\/p>\n<p>Similaire au <a title=\" R\u00e9vision des loyers commerciaux\" href=\"https:\/\/www.legalife.fr\/blog\/revision-des-loyers-commerciaux\/\"> syst\u00e8me r\u00e9gissant les baux commerciaux<\/a>, la r\u00e9vision des baux d\u2019habitation est toutefois bien plus favorable au locataire par rapport \u00e0 la r\u00e9vision des baux commerciaux.<\/p>\n<p>Nous allons faire le point sur la r\u00e9vision des loyers des baux d\u2019habitation r\u00e9gis par la loi du 6 juillet 1989 tendant \u00e0 am\u00e9liorer les rapports locatifs.<\/p>\n<h2 style=\"text-align: justify;\">Quelles conditions remplir pour pouvoir r\u00e9viser le loyer d\u2019un bail d\u2019habitation ?<\/h2>\n<p>Lorsque vous souhaitez r\u00e9viser le loyer d\u2019un bail d\u2019habitation (<a title=\"Bail d'habitation meubl\u00e9e\" href=\" https:\/\/www.legalife.fr\/document\/bail-dhabitation-meublee\">meubl\u00e9e<\/a>, <a title=\"Bail d'habitation non meubl\u00e9e\" href=\" https:\/\/www.legalife.fr\/document\/bail-dhabitation-non-meublee\"> non meubl\u00e9e<\/a>, <a title=\"Bail saisonnier d'habitation\" href=\" https:\/\/www.legalife.fr\/document\/bail-saisonnier-dhabitation\"> saisonnier<\/a> par exemple), vous devez tout d\u2019abord vous assurer d\u2019avoir pr\u00e9vu une clause de r\u00e9vision du loyer dans votre contrat de bail.
