Pass\u00e9 un certain d\u00e9lai, le <a href=\"https:\/\/www.legalife.fr\/modele\/bail-commercial\">bail commercial<\/a> peut \u00eatre r\u00e9vis\u00e9, selon des r\u00e8gles sp\u00e9cifiques \u00e0 cette r\u00e9vision du loyer commercial.<\/p>\n<p>Un bail commercial peut avoir \u00e9t\u00e9 sign\u00e9 avec un loyer fixe ou un loyer variable. Les r\u00e8gles de r\u00e9vision diff\u00e8rent en ce qui concerne le type de loyer pr\u00e9vu dans le contrat de bail.<\/p>\n<p>Nous allons donc vous proposer un court article, permettant de d\u00e9celer l\u2019indexation des loyers commerciaux.<\/p>\n<div id=\"toc_container\" class=\"no_bullets\"><p class=\"toc_title\">Table des mati&egrave;res<\/p><ul class=\"toc_list\"><li><a href=\"#Revision_du_loyer_dun_bail_commercial_fixe\"><span class=\"toc_number toc_depth_1\">1<\/span> R\u00e9vision du loyer d\u2019un bail commercial fixe<\/a><ul><li><a href=\"#La_possibilite_de_revision_du_loyer_commercial_sur_demande\"><span class=\"toc_number toc_depth_2\">1.1<\/span> La possibilit\u00e9 de r\u00e9vision du loyer commercial sur demande<\/a><\/li><li><a href=\"#La_possibilite_de_deplafonnement_de_la_revision_du_loyer_commercial\"><span class=\"toc_number toc_depth_2\">1.2<\/span> La possibilit\u00e9 de d\u00e9plafonnement de la r\u00e9vision du loyer commercial<\/a><\/li><\/ul><\/li><li><a href=\"#Revision_du_loyer_dans_un_bail_commercial_a_clause_dechelle_mobile\"><span class=\"toc_number toc_depth_1\">2<\/span> R\u00e9vision du loyer dans un bail commercial \u00e0 clause d\u2019\u00e9chelle mobile<\/a><\/li><\/ul><\/div>\n<h2 style=\"text-align: justify;\"><span id=\"Revision_du_loyer_dun_bail_commercial_fixe\">R\u00e9vision du loyer d\u2019un bail commercial fixe<\/span><\/h2>\n<h3><span id=\"La_possibilite_de_revision_du_loyer_commercial_sur_demande\">La possibilit\u00e9 de r\u00e9vision du loyer commercial sur demande<\/span><\/h3>\n<p>Lorsque vous avez conclu un bail avec votre locataire, le loyer peut faire l\u2019objet d\u2019une r\u00e9vision. Cette r\u00e9vision du loyer reste possible m\u00eame si vous n\u2019avez pas pr\u00e9vu de clause \u00e0 cet effet.<\/p>\n<p>Elle intervient \u00e0 la <a title=\"demande de r\u00e9vision du loyer d'un bail commercial\" href=\"https:\/\/www.legalife.fr\/document\/demande-amiable-de-revision-du-loyer-dun-bail-commercial\">demande du bailleur<\/a> o\u00f9 \u00e0 la <a title=\"demande de r\u00e9vision du loyer d'un bail commercial\" href=\"https:\/\/www.legalife.fr\/document\/demande-amiable-de-revision-du-loyer-dun-bail-commercial\">demande du locataire<\/a>. Ces demandes doivent \u00eatre adress\u00e9es\u00a0par lettre recommand\u00e9e avec accus\u00e9 de r\u00e9ception, ou par signification d\u2019huissier. Elles doivent intervenir au minimum 3\u00a0ans apr\u00e8s l\u2019entr\u00e9e en jouissance du locataire dans les lieux faisant l\u2019objet du bail.<\/p>\n<p>La demande doit d\u00e9j\u00e0 contenir le nouveau loyer demand\u00e9. Ce loyer ne peut toutefois\u00a0\u00eatre sup\u00e9rieur au loyer de base modifi\u00e9 par l\u2019indice correspondant. Il est d\u00e9termin\u00e9 par l\u2019institut national des \u00e9tudes \u00e9conomiques et statistiques (INSEE).<\/p>\n<p><a title=\"les apports de la loi Pinel pour les baux commerciaux\" href=\"https:\/\/www.legalife.fr\/guides-juridiques\/baux-commerciaux--les-apports-de-la-loi-pinel\">Depuis la\u00a0loi du 18 juin 2014<\/a>, dite loi Pinel, l\u2019indice applicable varie selon l\u2019activit\u00e9 qu\u2019exerce le locataire dans les locaux lou\u00e9s :<\/p>\n<ul>\n<li>Le locataire exerce une activit\u00e9 commerciale. Le montant du loyer peut alors \u00eatre recalcul\u00e9 sans\u00a0d\u00e9passer le loyer de base modifi\u00e9 par l\u2019indice des loyers commerciaux (ILC) ; ou<\/li>\n<\/ul>\n<ul>\n<li>Le locataire exerce une activit\u00e9 tertiaire. Le montant du loyer peut \u00eatre recalcul\u00e9 sans\u00a0d\u00e9passer le loyer de base modifi\u00e9 par l\u2019indice des loyers des activit\u00e9s tertiaires (ILAT).<\/li>\n<\/ul>\n<p>Il est d\u00e9sormais impossible de modifier le montant du loyer d\u00fb en fonction de l\u2019indice du co\u00fbt de la construction. Ce dernier est en effet d\u00e9suet en la mati\u00e8re depuis le 1er septembre 2014.<\/p>\n<h3><span id=\"La_possibilite_de_deplafonnement_de_la_revision_du_loyer_commercial\">La possibilit\u00e9 de d\u00e9plafonnement de la r\u00e9vision du loyer commercial<\/span><\/h3>\n<p>L\u2019<a href=\"https:\/\/www.legifrance.gouv.fr\/affichCodeArticle.do?cidTexte=LEGITEXT000005634379&amp;idArticle=LEGIARTI000006222054&amp;dateTexte=&amp;categorieLien=cid\">article L 145-38 du Code de commerce<\/a> dispose qu\u2019en cas de modification des facteurs locaux de commercialit\u00e9 entra\u00eenant une augmentation de plus de 10% de la valeur locative, il peut y avoir un d\u00e9plafonnement dans la r\u00e9vision du loyer. Cela signifie\u00a0que vous n\u2019\u00eates pas tenus d\u2019observer les plafonds fix\u00e9s par les indices ILC ou ILAT de l\u2019INSEE.<\/p>\n<p>Cependant, ce d\u00e9plafonnement n\u2019est possible que sous condition de preuve. C&#8217;est la preuve de l\u2019augmentation de la valeur locative due \u00e0 cette modification des facteurs locaux de commercialit\u00e9.<\/p>\n<p>Que la r\u00e9vision soit faite en suivant les plafonds fix\u00e9s par les indices de l\u2019INSEE ou qu\u2019elle soit d\u00e9plafonn\u00e9e, le nouveau loyer ne peut pas correspondre \u00e0 une augmentation sup\u00e9rieure \u00e0 10% du loyer pay\u00e9 l\u2019ann\u00e9e pr\u00e9c\u00e9dant ladite r\u00e9vision.<\/p>\n<p>Une fois la r\u00e9vision faite, l\u2019article L 145-38 du Code de commerce pr\u00e9voit qu\u2019elle prend effet d\u00e8s la date de demande de r\u00e9vision du bail commercial. Par la suite, si vous souhaitez effectuer une nouvelle r\u00e9vision, il vous faudra attendre trois ans de plus \u00e0 compter de la date de la demande du bail.<\/p>\n<h2 style=\"text-align: justify;\"><span id=\"Revision_du_loyer_dans_un_bail_commercial_a_clause_dechelle_mobile\">R\u00e9vision du loyer dans un bail commercial \u00e0 clause d\u2019\u00e9chelle mobile<\/span><\/h2>\n<p>La clause d\u2019\u00e9chelle mobile est une clause pouvant \u00eatre incluse dans un bail qui stipule que le loyer est ajust\u00e9 annuellement ou trimestriellement. La clause peut cependant pr\u00e9voir une laps de temps diff\u00e9rent.<\/p>\n<p>Lorsque la clause est pr\u00e9vue, le loyer est r\u00e9ajust\u00e9 automatiquement \u00e0 la p\u00e9riode d\u00e9termin\u00e9e par la clause. Cette r\u00e9vision du loyer intervient sans que les parties aient \u00e0 en faire la demande.<\/p>\n<p>Cependant, il y a une limite \u00e0 ce r\u00e9ajustement. En principe, les parties peuvent choisir l\u2019indice qui leur convient.
