Il est requis lors de certaines demandes faites aupr\u00e8s de l\u2019administration. Notamment en cas de demande d\u2019aide au logement, ou encore lors de l\u2019inscription ou modification des mentions d\u2019inscription aupr\u00e8s de certains organismes publics.<\/p>\n<p style=\"text-align: justify;\">La quittance de loyer est r\u00e9gie par la loi du 6 juillet 1989 tendant \u00e0 am\u00e9liorer les rapports locatifs. Son r\u00e9gime a \u00e9t\u00e9 modifi\u00e9 en dernier lieu par la loi du 24 mars 2014. Cette r\u00e9forme\u00a0a introduit une nouvelle facult\u00e9 en ce qui concerne la d\u00e9livrance de la quittance.<\/p>\n<div id=\"toc_container\" class=\"no_bullets\"><p class=\"toc_title\">Table des mati&egrave;res<\/p><ul class=\"toc_list\"><li><a href=\"#Obligation_legale_de_delivrer_une_quittance_de_loyer\"><span class=\"toc_number toc_depth_1\">1<\/span> Obligation l\u00e9gale de d\u00e9livrer une quittance de loyer<\/a><\/li><li><a href=\"#Mentions_a_inclure_dans_la_quittance_de_loyer\"><span class=\"toc_number toc_depth_1\">2<\/span> Mentions \u00e0 inclure dans la quittance de loyer<\/a><\/li><li><a href=\"#Modalites_de_delivrance_de_la_quittance_de_loyer\"><span class=\"toc_number toc_depth_1\">3<\/span> Modalit\u00e9s de d\u00e9livrance de la quittance de loyer<\/a><\/li><\/ul><\/div>\n<h2 style=\"text-align: justify;\"><span id=\"Obligation_legale_de_delivrer_une_quittance_de_loyer\">Obligation l\u00e9gale de d\u00e9livrer une quittance de loyer<\/span><\/h2>\n<p style=\"text-align: justify;\">Aux termes de l\u2019article 21 de la loi du 6 juillet 1989 \u00e0 jour des modifications effectu\u00e9es par la loi du 24 mars 2014 : \u201c<em>Le bailleur ou son mandataire est tenu de transmettre gratuitement une quittance au locataire qui en fait la demande.<\/em> La quittance porte le d\u00e9tail des sommes vers\u00e9es par le locataire en distinguant le loyer et les charges\u201d.<\/p>\n<p style=\"text-align: justify;\">Par cons\u00e9quent, <strong>le bailleur est tenu de transmettre une quittance de loyer \u00e0 son locataire lorsque celui-ci en fait la demande.<\/strong> Elle est un \u00e9l\u00e9ment important des <a title=\"Les rapports bailleur-locataire\" href=\" https:\/\/www.legalife.fr\/guides-juridiques\/les-rapports-bailleur--locataire\"> rapports entre le locataire et son bailleur<\/a>.<\/p>\n<p style=\"text-align: justify;\">Si le locataire n\u2019en fait pas la demande, aucune obligation l\u00e9gale n&#8217;impose au bailleur de proc\u00e9der \u00e0 la d\u00e9livrance d\u2019une quittance. Elle n\u2019est donc pas syst\u00e9matique.<\/p>\n<p style=\"text-align: justify;\">Veuillez noter que l\u2019article 21 de la loi du 6 juillet 1989 dispose \u00e9galement que \u201c<em>si le locataire effectue un paiement partiel, le bailleur est tenu de d\u00e9livrer un <a title=\"Re\u00e7u de paiement partiel de loyer\" href=\" https:\/\/www.legalife.fr\/document\/recu-de-paiement-partiel-de-loyer\"> re\u00e7u<\/a><\/em>\u201d.<\/p>\n<p style=\"text-align: justify;\">Pour r\u00e9capituler, le bailleur n\u2019est que l\u00e9galement tenu de d\u00e9livrer une quittance si :<\/p>\n<ul style=\"text-align: justify;\">\n<li style=\"text-align: justify;\">Le locataire a acquitt\u00e9 int\u00e9gralement le loyer ; et<\/li>\n<li style=\"text-align: justify;\">Si le locataire en fait express\u00e9ment la demande aupr\u00e8s du bailleur.<\/li>\n<\/ul>\n<p style=\"text-align: justify;\"><a href=\"https:\/\/www.legalife.fr\/modele\/quittance-de-loyer\"><img class=\"alignnone size-med&lt;a href=\" alt=\"\" \/><\/a><a href=\"https:\/\/www.legalife.fr\/modele\/quittance-de-loyer\/creation_document\"><img loading=\"lazy\" class=\"alignnone wp-image-4256 size-full\" src=\"https:\/\/www.legalife.fr\/blog\/wp-content\/uploads\/2013\/11\/Gratuit-1.png\" alt=\"quittance de loyer visuel\" width=\"700\" height=\"410\" srcset=\"https:\/\/d1mxkq1wocxjoy.cloudfront.net\/guides-uploads\/2013\/11\/22230245\/Gratuit-1.png 700w, https:\/\/d1mxkq1wocxjoy.cloudfront.net\/guides-uploads\/2013\/11\/22230245\/Gratuit-1-300x176.png 300w\" sizes=\"(max-width: 700px) 100vw, 700px\" \/><\/a><\/p>\n<h2 style=\"text-align: justify;\"><span id=\"Mentions_a_inclure_dans_la_quittance_de_loyer\">Mentions \u00e0 inclure dans la quittance de loyer<\/span><\/h2>\n<p style=\"text-align: justify;\">L\u2019article 21 indique que <strong>la quittance doit indiquer les sommes vers\u00e9es par le locataire en distinguant le loyer et les charges<\/strong>. Ces mentions doivent s\u2019ajouter \u00e0 d\u2019autres afin de rendre la quittance pr\u00e9cise.<\/p>\n<p style=\"text-align: justify;\">En effet, il est pr\u00e9f\u00e9rable d&#8217;inclure les mentions suivantes dans la quittance de loyer :<\/p>\n<ul>\n<li style=\"text-align: justify;\">Le nom, le pr\u00e9nom et l\u2019adresse du bailleur ;<\/li>\n<li style=\"text-align: justify;\">Le nom, le pr\u00e9nom et l\u2019adresse du locataire ;<\/li>\n<li style=\"text-align: justify;\">Le montant correspondant au loyer acquitt\u00e9 ainsi que les charges acquitt\u00e9es ; et<\/li>\n<li style=\"text-align: justify;\">La date d\u2019occupation des lieux correspondant aux montants acquitt\u00e9s.<\/li>\n<\/ul>\n<h2 style=\"text-align: justify;\"><span id=\"Modalites_de_delivrance_de_la_quittance_de_loyer\">Modalit\u00e9s de d\u00e9livrance de la quittance de loyer<\/span><\/h2>\n<p style=\"text-align: justify;\">La quittance de loyer doit \u00eatre d\u00e9livr\u00e9e au locataire demandeur gratuitement.
