C&#8217;est une op\u00e9ration agr\u00e9\u00e9e par l&#8217;Etat.<\/p>\n<p><span style=\"text-decoration: underline;\">L&#8217;op\u00e9ration de PSLA se formalise soit : <\/span><\/p>\n<ul>\n<li>Par un engagement unilat\u00e9ral de l&#8217;\u00e9tablissement de cr\u00e9dit<\/li>\n<li>Par une convention conclue avec l&#8217;op\u00e9rateur<\/li>\n<\/ul>\n<p>En pratique, l&#8217;op\u00e9rateur et l&#8217;Etat signent une convention de PSLA. L&#8217;op\u00e9rateur est une personne morale (un constructeur social ou un promoteur priv\u00e9). Il est vendeur et propri\u00e9taire du logement financ\u00e9 en PSLA.<\/p>\n<p>Cette op\u00e9ration devra \u00eatre agr\u00e9\u00e9e par le repr\u00e9sentant de l&#8217;Etat dans le d\u00e9partement.\u00a0En cas de d\u00e9l\u00e9gation de comp\u00e9tence, un repr\u00e9sentant d&#8217;une collectivit\u00e9 territoriale pourra agr\u00e9er l&#8217;op\u00e9ration.<\/p>\n<p>En ce qui concerne les SCI, l&#8217;op\u00e9ration financ\u00e9e en PSLA se d\u00e9roule diff\u00e9remment. Si la SCI est en m\u00eame temps op\u00e9rateur et b\u00e9n\u00e9ficiaire du PSLA, deux op\u00e9rations sont possibles.<\/p>\n<ul>\n<li>Soit la SCI proc\u00e8de elle-m\u00eame \u00e0 la livraison de son logement.<\/li>\n<li>Soit le logement est acquis par la SCI \u00e0 un promoteur qui peut-\u00eatre l&#8217;op\u00e9rateur \u00e0 l&#8217;initiative du projet.<\/li>\n<\/ul>\n<p>Dans un second temps, l&#8217;op\u00e9rateur\u00a0conclut un contrat avec le locataire-acc\u00e9dant (<em>locataire du logement financ\u00e9 en PSLA avant la lev\u00e9e de l&#8217;option<\/em>). Il s&#8217;engage \u00e0 lui transf\u00e9rer,\u00a0\u00e0 la lev\u00e9e de l&#8217;option, la propri\u00e9t\u00e9 d&#8217;un logement. Par ailleurs, il peut \u00eatre \u00e9galement pr\u00e9vu dans la convention que le PSLA\u00a0soit transf\u00e9r\u00e9 au locataire-acc\u00e9dant au moment de la lev\u00e9e de l&#8217;option.<\/p>\n<p>Le PSLA est un pr\u00eat destin\u00e9 \u00e0 offrir des logements neufs aux m\u00e9nages dont les revenus, \u00e0 la date du contrat de location-accession, n&#8217;exc\u00e8dent pas un plafond <u>fix\u00e9 par arr\u00eat\u00e9<\/u>\u00a0<a href=\"https:\/\/www.legifrance.gouv.fr\/affichCodeArticle.do?idArticle=LEGIARTI000029728777&amp;cidTexte=LEGITEXT000006074096&amp;dateTexte=20141106\">(article R. 331-76-5-1 du Code de la construction<\/a> <a href=\"https:\/\/www.legifrance.gouv.fr\/affichCodeArticle.do?idArticle=LEGIARTI000029728777&amp;cidTexte=LEGITEXT000006074096&amp;dateTexte=20141106\">et de l&#8217;habitation (CCH)).<\/a><\/p>\n<h2><span id=\"Lors_de_la_phase_locative\"><strong><span style=\"text-decoration: underline;\">Lors de la phase locative :\u00a0<\/span><\/strong><\/span><\/h2>\n<p>Pendant la phase locative, avant la lev\u00e9e de l&#8217;option, le locataire-acc\u00e9dant verse une redevance \u00e0 l&#8217;op\u00e9rateur. Celle-ci correspond \u00e0 un loyer qui sera par la suite imputable sur le prix de vente du logement. Par ailleurs, le locataire-acc\u00e9dant verse une \u00e9pargne \u00e0 l&#8217;op\u00e9rateur.<\/p>\n<p>De plus, il convient de pr\u00e9ciser qu&#8217;un logement financ\u00e9 par PSLA ne peut \u00eatre occup\u00e9 qu&#8217;\u00e0 titre de r\u00e9sidence principale.<\/p>\n<p>Par ailleurs, le logement doit \u00eatre occup\u00e9 par le m\u00e9nage pendant toute la dur\u00e9e du remboursement du pr\u00eat.<\/p>\n<p>En cons\u00e9quence, le locataire-acc\u00e9dant est responsable de l&#8217;entretien de son logement. Ces plafonds varient en fonction du nombre de personnes r\u00e9sidant dans le logement et de la zone g\u00e9ographique.<\/p>\n<h1><span id=\"Aquoi_sert_le_pret_social_location-accession\"><em><strong>A\u00a0quoi sert le pr\u00eat social location-accession ?\u00a0<\/strong><\/em><\/span><\/h1>\n<p>Le PSLA permet \u00e0 des personnes de condition modeste d&#8217;acc\u00e9der au logement et d&#8217;\u00eatre propri\u00e9taires de leur r\u00e9sidence principale.<\/p>\n<p>Seules les op\u00e9rations de construction ou les acquisitions de logements neufs peuvent \u00eatre financ\u00e9es par un PSLA.<\/p>\n<p>Le prix de vente des logements financ\u00e9s par le PSLA ne doit pas d\u00e9passer une valeur fix\u00e9e en euros, au m\u00e8tre carr\u00e9 de surface utile et variable en fonction de la zone g\u00e9ographique . <a href=\"https:\/\/www.legifrance.gouv.fr\/affichTexte.do;jsessionid=6F1D3E74A0CFC544B9C9F85F83EBCF56.tplgfr41s_2?cidTexte=JORFTEXT000029337646&amp;dateTexte=20190313\">L&#8217;arr\u00eat\u00e9 du 1er ao\u00fbt 2014<\/a>\u00a0\u00e9tablit une r\u00e9partition de toutes les villes en zone g\u00e9ographique (A bis, A, B1, B2 et C).<\/p>\n<p>De plus, les valeurs vis\u00e9es par <a href=\"https:\/\/www.legifrance.gouv.fr\/affichCodeArticle.do?cidTexte=LEGITEXT000006074096&amp;idArticle=LEGIARTI000023361778&amp;dateTexte=29990101&amp;categorieLien=cid\">l&#8217;article R. 304-1 du CCH<\/a> sont r\u00e9vis\u00e9es annuellement en fonction de la variation de l&#8217;indice du co\u00fbt de la construction.<\/p>\n<p>Par ailleurs, il\u00a0faut\u00a0prendre en compte les \u00e9ventuelles subventions des collectivit\u00e9s territoriales dans la fixation du prix de vente.<\/p>\n<p>Toutefois, le prix de vente fix\u00e9 n&#8217;est pas r\u00e9visable. Il subit une minoration de 1% par an \u00e0 compter de la date de conclusion du contrat de location-accession.<\/p>\n<p>Le PSLA, peut couvrir jusqu&#8217;\u00e0 100%\u00a0 du montant de l&#8217;achat du bien.<\/p>\n<p>L&#8217;op\u00e9ration est un pr\u00eat d&#8217;une dur\u00e9e d&#8217;amortissement de 30 ans pouvant \u00eatre allong\u00e9e de 5 ans ouvrant droit au versement au m\u00e9nage pendant la p\u00e9riode de location du logement de l&#8217;APL.<\/p>\n<h2><span id=\"La_levee_de_l8217option\"><span style=\"text-decoration: underline;\"><strong>La lev\u00e9e de l&#8217;option:\u00a0<\/strong><\/span><\/span><\/h2>\n<p>Il peut \u00eatre pr\u00e9vu dans le contrat de location-accession plusieurs dates de lev\u00e9e de l&#8217;option par le m\u00e9nage sur son logement. Par cons\u00e9quent, un prix de vente est fix\u00e9 pour chacune des dates convenues ainsi que la minoration contractuelle appliqu\u00e9e.<\/p>\n<p>Lorsque le locataire-acc\u00e9dant d\u00e9cide de lever l&#8217;option, la propri\u00e9t\u00e9 du logement lui est transf\u00e9r\u00e9e. Toutefois, il est possible de pr\u00e9voir que ce transfert sera subordonn\u00e9 \u00e0 la condition suspensive de l&#8217;obtention d&#8217;un pr\u00eat ou plusieurs pr\u00eats ainsi que le paiement du solde du prix du logement.<\/p>\n<p>Lorsque l&#8217;option est lev\u00e9e avant la date convenue, le locataire-acc\u00e9dant b\u00e9n\u00e9ficie de la d\u00e9cote annuelle de 1,5%. Cependant, si l&#8217;acc\u00e9dant renonce \u00e0 l&#8217;acquisition de son logement, il ne b\u00e9n\u00e9ficie d&#8217;aucun droit au maintien dans les lieux mais se fait rembourser les sommes vers\u00e9es au titre de la fraction acquisitive de la redevance.<\/p>\n<p>Par ailleurs, si au terme de la p\u00e9riode de 18 mois de commercialisation, l&#8217;op\u00e9rateur n&#8217;a pas trouv\u00e9 de candidat \u00e0 la location-accession, le logement peut \u00eatre conventionn\u00e9 en loyer PLS en conservant les avantages fiscaux initiaux du PSLA. D\u00e8s que le transfert de propri\u00e9t\u00e9 est intervenu, le logement peut \u00eatre revendu.<\/p>\n<p><a href=\"https:\/\/d1mxkq1wocxjoy.cloudfront.net\/guides-uploads\/2015\/11\/12165448\/businessman-signing-legal-contract-1.jpg\"><img loading=\"lazy\" class=\"alignnone wp-image-10313 aligncenter\" src=\"https:\/\/d1mxkq1wocxjoy.cloudfront.net\/guides-uploads\/2018\/06\/15134321\/ch%C3%A8que-2.jpg\" alt=\"\" width=\"500\" height=\"413\" \/><br \/>\n<\/a><\/p>\n<h1><span id=\"Quels_sont_les_avantages_du_pret_social_location-accession\"><em><strong>Quels sont les avantages du pr\u00eat social location-accession ?\u00a0<\/strong><\/em><\/span><\/h1>\n<ul>\n<li>TVA r\u00e9duite \u00e0 5,5%<\/li>\n<li>Minoration du prix de vente d&#8217;au moins 1% par ann\u00e9e de location<\/li>\n<li>Exon\u00e9ration de la taxe fonci\u00e8re pour une dur\u00e9e de 15 ans.<\/li>\n<li>Frais de notaire r\u00e9duits<\/li>\n<li>B\u00e9n\u00e9fice d&#8217;un dispositif de s\u00e9curisation de l&#8217;accession<\/li>\n<\/ul>\n<p>De plus, il est possible de cumuler le PSLA avec un autre pr\u00eat conventionn\u00e9 y compris en cas de transfert de propri\u00e9t\u00e9. Des pr\u00eats compl\u00e9mentaires du pr\u00eat conventionn\u00e9 peuvent \u00e9galement \u00eatre cumul\u00e9s avec le PSLA.<\/p>\n<h2><span id=\"Pour_resume_la_convention_faisant_l8217objet_d8217un_PSLA_doit_prevoir\"><span style=\"text-decoration: underline;\"><strong>Pour r\u00e9sum\u00e9, la convention faisant l&#8217;objet d&#8217;un PSLA doit pr\u00e9voir :<\/strong><\/span><\/span><\/h2>\n<ul>\n<li style=\"list-style-type: none;\">\n<ul>\n<li>Un engagement du vendeur :\n<ul>\n<li>de r\u00e9server les logements \u00e0 des m\u00e9nages dont les ressources annuelles n&#8217;exc\u00e8dent pas \u00e0 la date de signature du contrat, les plafonds de ressources PAS<\/li>\n<li>de respecter, durant la phase locative, des plafonds de loyer fix\u00e9s selon les zones g\u00e9ographiques<\/li>\n<li>\u00e0 offrir au m\u00e9nage, une garantie de rachat de son relogement et une garantie de relogement en cas de d\u00e9c\u00e8s, ch\u00f4mage, etc. La demande de mise en jeu de la garantie devant intervenir dans l&#8217;ann\u00e9e qui suit la survenance de l&#8217;al\u00e9a.<\/li>\n<\/ul>\n<\/li>\n<li>Le caract\u00e8re plafonn\u00e9 et non-r\u00e9visable du prix de vente du logement<\/li>\n<\/ul>\n<\/li>\n<\/ul>\n<ul>\n<li style=\"text-align: left;\">Le fait qu&#8217;un \u00e9tablissement de cr\u00e9dit propose au m\u00e9nage lors de la lev\u00e9e de l&#8217;option, un ou des pr\u00eats conventionn\u00e9s dont la mensualit\u00e9 n\u2019exc\u00e9dera pas la derni\u00e8re redevance
