est permise en vertu du principe de libre circulation des ressortissants de l&#8217;UE.\u00a0 Cependant pour un \u00e9tranger non ressortissant de l&#8217;UE, une proc\u00e9dure stricte est \u00e0 pr\u00e9alables<\/span><\/h2>\n<p>Pour travailler en France, un ressortissant \u00e9tranger non europ\u00e9en doit poss\u00e9der, outre les documents obligatoires pour toute embauche, un document valant autorisation de travail.<\/p>\n<p>Ces documents peuvent \u00eatre :<\/p>\n<ul>\n<li>visa<\/li>\n<li>carte de s\u00e9jour autorisant \u00e0 exercer une activit\u00e9 professionnelle salari\u00e9e<\/li>\n<li>carte de s\u00e9jour\u00a0comportant une autorisation provisoire de travail<\/li>\n<\/ul>\n<p><span style=\"text-decoration: underline;\">A noter :<\/span><\/p>\n<ul>\n<li>certains titres ouvrent directement droit au travail sans avoir besoin d&#8217;une autorisation expresse (ex : APS, VLS-TS, carte de s\u00e9jour &#8220;comp\u00e9tences et talents&#8221;&#8230;)<\/li>\n<li>Cette obligation concerne n&#8217;importe quel type de contrat de travail (CDD ou CDI) et aucune distinction n&#8217;est faite entre les primo arrivants et ceux r\u00e9sidents depuis des ann\u00e9es en France.<\/li>\n<\/ul>\n<h2><span id=\"Recruterun_salarie_etranger_non-resident_en_France\">Recruter\u00a0un salari\u00e9 \u00e9tranger non-r\u00e9sident en France<\/span><\/h2>\n<p>En tant qu&#8217;employeur, vous\u00a0\u00eates dans l&#8217;obligation de demander une autorisation de travail.<\/p>\n<h3><span id=\"La_procedure_d8217introduction\">La proc\u00e9dure d&#8217;introduction<\/span><\/h3>\n<p><span style=\"text-decoration: underline;\">Par \u00e9tape, vous devez donc :<\/span><\/p>\n<ol>\n<li>d\u00e9poser l&#8217;offre d&#8217;emploi aupr\u00e8s de P\u00f4le emploi (ou autre organisme de placement tel Apec par exemple )\u00a0pour obtenir une attestation de recherches infructueuses des candidats sur le territoire\u00a0fran\u00e7ais \u00a0;<\/li>\n<li>transmettre le dossier de demande d&#8217;introduction \u00e0 la <u>Direccte <em>(direction r\u00e9gionale des entreprises de la concurrence de la consommation du travail et de l&#8217;emploi<\/em>)\u00a0<\/u>\u00a0du lieu du travail.<\/li>\n<\/ol>\n<p><span style=\"text-decoration: underline;\">Ce dossier\u00a0doit comporter\u00a0 vous concernant :<\/span><\/p>\n<ul>\n<li>l&#8217;engagement de paiement des taxes \u00e0 l&#8217;Office fran\u00e7ais de l&#8217;immigration et de l&#8217;int\u00e9gration (OFII)\u00a0;<\/li>\n<li>Un projet du contrat de travail\u00a0;<\/li>\n<li>\u00a0le formulaire cerfa n\u00b015187*01<\/li>\n<li>des informations diverses sur votre entreprise (Kbis, statuts, etc)\u00a0;<\/li>\n<li>une copie du dernier bordereau de versement des cotisations et contributions sociales\u00a0;<\/li>\n<li>des justificatifs des recherches infructueuses exerc\u00e9es au pr\u00e9alable<\/li>\n<\/ul>\n<p><span style=\"text-decoration: underline;\">concernant le salari\u00e9 :<\/span><\/p>\n<ul>\n<li>un imprim\u00e9 sur les conditions de logement du futur salari\u00e9,<\/li>\n<li>3 photos,<\/li>\n<li>une copie du document national d&#8217;identit\u00e9 du salari\u00e9,<\/li>\n<li>un justificatif de la qualification et de l&#8217;exp\u00e9rience du futur salari\u00e9 (dipl\u00f4me, titre, etc)<\/li>\n<\/ul>\n<p>Si la Direccte<span style=\"text-decoration: underline;\"> accepte la demande<\/span> (d\u00e9lai de 2 \u00e0 3 mois) elle transmet le dossier au\u00a0consulat concern\u00e9\u00a0et \u00e0 l&#8217;OFII. Cette derni\u00e8re assurera le contr\u00f4le m\u00e9dical (qui peut intervenir dans les 3 mois apr\u00e8s l&#8217;arriv\u00e9e en France ou apr\u00e8s le d\u00e9but de l&#8217;activit\u00e9 concern\u00e9e) et l&#8217;acheminement du travailleur \u00e9tranger vers la France.<\/p>\n<p><span style=\"text-decoration: underline;\">A savoir<\/span> : le recrutement est facilit\u00e9 si vous \u00eates \u00e9ligibles au dispositif du passeport talent <a href=\"https:\/\/visa.lafrenchtech.com\/\">(French Visa Tech)<\/a>.<\/p>\n<p><a href=\"https:\/\/d1mxkq1wocxjoy.cloudfront.net\/guides-uploads\/2015\/12\/22225927\/barreau-de-Paris.jpg\"><img loading=\"lazy\" class=\"alignnone wp-image-11213 size-full\" src=\"https:\/\/d1mxkq1wocxjoy.cloudfront.net\/guides-uploads\/2019\/04\/05153015\/shutterstock_1230398623.jpg\" alt=\"\" width=\"4288\" height=\"2848\" \/><\/a><\/p>\n<h2><span id=\"Recruter_un_salarie_etranger_deja_resident_en_France\">Recruter un salari\u00e9 \u00e9tranger d\u00e9j\u00e0 r\u00e9sident en France<\/span><\/h2>\n<div>\n<h3 class=\"fiche-title-1\"><span id=\"La_demande_d8217authentification_du_titre_de_sejour\">La demande d&#8217;authentification du titre de s\u00e9jour<\/span><\/h3>\n<p>En tant qu&#8217;employeur, vous devez imp\u00e9rativement v\u00e9rifier avant\u00a0d&#8217;engager le futur salari\u00e9 que celui-ci est bel et bien titulaire d&#8217;un titre de s\u00e9jour valable, donc l&#8217;autorisant \u00e0 travailler\u00a0en France.<\/p>\n<p>Ainsi, au minimum de 2 jours ouvrables avant la date d&#8217;effet de l&#8217;embauche, il vous faudra donc demander \u00e0 la pr\u00e9fecture du d\u00e9partement du lieu d&#8217;embauche l&#8217;authentification du titre de s\u00e9jour ou de l&#8217;autorisation de travailleur du ressortissant \u00e9tranger.<\/p>\n<p><span style=\"text-decoration: underline;\">A savoir : <\/span><\/p>\n<ul>\n<li>Cette demande peut \u00eatre r\u00e9alis\u00e9e de fa\u00e7on d\u00e9mat\u00e9rialis\u00e9e, donc par courrier \u00e9lectronique (accompagn\u00e9e d&#8217;une copie du titre\u00a0autorisant le travail de l&#8217;\u00e9tranger).<\/li>\n<li>Cette formalit\u00e9 est r\u00e9put\u00e9e acquise si aucune r\u00e9ponse ne vous parvient dans les 2 jours ouvrables suivant r\u00e9ception de la demande.<\/li>\n<li>Une copie du titre valant autorisation de travail doit \u00eatre annex\u00e9e au registre unique du personnel.<\/li>\n<\/ul>\n<p>Apr\u00e8s v\u00e9rification du titre, vous pourrez\u00a0enfin proc\u00e9der aux\u00a0d\u00e9marches d&#8217;embauche usuelles.<\/p>\n<\/div>\n<h2><span id=\"Les_sanctions_en_cas_d8217embauche_d8217un_etranger_sans_titre_valable\">Les sanctions en cas d&#8217;embauche d&#8217;un \u00e9tranger sans titre valable :<a href=\"https:\/\/d1mxkq1wocxjoy.cloudfront.net\/guides-uploads\/2015\/11\/22230157\/sanction-salari%C3%A9.jpg\"><img loading=\"lazy\" class=\"alignnone size-full wp-image-4639\" src=\"https:\/\/d1mxkq1wocxjoy.cloudfront.net\/guides-uploads\/2015\/11\/22230157\/sanction-salari%C3%A9.jpg\" alt=\"sanction salari\u00e9\" width=\"810\" height=\"540\" srcset=\"https:\/\/d1mxkq1wocxjoy.cloudfront.net\/guides-uploads\/2015\/11\/22230157\/sanction-salari%C3%A9.jpg 810w, https:\/\/d1mxkq1wocxjoy.cloudfront.net\/guides-uploads\/2015\/11\/22230157\/sanction-salari%C3%A9-300x200.jpg 300w\" sizes=\"(max-width: 810px) 100vw, 810px\" \/><\/a><\/span><\/h2>\n<ul>\n<li>5 ans d&#8217;emprisonnement et une amende de 15 000 \u20ac et 75 000\u20ac pour les personnes morales<\/li>\n<li>10 ans d&#8217;emprisonnement et une amende de 100 000\u20ac si l&#8217;infraction est commise en bande organis\u00e9e<\/li>\n<\/ul>\n<p><span style=\"text-decoration: underline;\">A noter<\/span> que ces peines peuvent \u00eatre compl\u00e9t\u00e9es par le juge, qui peut donc d\u00e9cider d&#8217; une interdiction temporaire de travail ou de la fermeture des march\u00e9s publics pour 5 ann\u00e9es.
